Re: PFD Example Letter

Ha ha, I hear ya.. I have been dumb, ignorant and irresponsible myself many of times, too many to count.
Ok so my understanding is it will fall off in 8/14, right? In that case it sounds like its a last ditch effort of a CA that bought it to collect... Good luck, right?
For now your in good shape. You did the right thing.. You sent a debt validation, questioning it and asking for proof of the debt but never acknowledging it.. That will take some time because it probably has been bought by a few collection agency's and passed through many hands. The DV gives you 30 days then after you receive the DV send the dispute which I have copied and pasted a easy letter for you.. It's to the point which I like it also shows you know your stuff so don't mess with me., ok so after the dispute is sent you have another 30 days, right? That's 2 months and by then it will be too late for them to collect., if they validate and prove its yours sooner than that I would do a PFD and only offer 10% of the debt and go up from there...25%, 50% and so on, this will buy even more time but I'm sure they will take the 10% knowing its ready to fall off. I think your going to win this one. How much is it for?

This is a Notice of Direct Dispute with you, under the provisions of FCRA §623(a)(8)(D), of the accuracy of information you have reported to my credit file.

► (If sent to a debt collector, (CA), it might be beneficial to also include the blurb

This is a direct dispute of credit reporting. This is not a request for debt validation/verification under FDCPA §809(b)

(don’t let them just simply sluff it off as a meaningless DV letter)

In compliance with FCRA §623(a)(8)(D), and enacting regulations published at 16 CFR § 660.4, this Notice of Direct dispute includes:

Identification of the specific information being disputed:

(specify the account number, and the specific information that is disputed under that identifying account)

Basis for the dispute:

(how the reporting was inaccurate; was any reporting in violation of any statutory or regulatory provisions? account or express agreements? CRA reporting gudelines? Account not yours? etc.)

Supporting documentation:

(all documents that support your dispute; it is recommened to also include, as part of your documentation, at least a copy of the portion only of your recent credit report showing their reporting of the disputed information was actually reported to your credit flle. The implementing rule suggests a showing that it appeared in your credit report)

Re: PFD Example Letter

I have a very dumb question as I'm very new to credit and rebuilding. I am about to prepare two different PFD letters for two different collection agencies. Both are for small amounts ($78, and $130). These are the only two derogatory remarks on my report per creditkarma. I plan on pretty much copying and pasting the letter in the first post of this thread; however, I'm not sure what that account # 0000xxxx refers to in the beginning of the letter? Where do I find this account #? Do I have unique account #s with each of the collection agencies and have to contact them each separately to get this info? Or is this some # that I should know or easily find somewhere? Do I absolutely have to have this account #, whatever it is, in the PFD letter, for them to properly identify who I am? Or will they just figure it out based on my name?

Thank you in advance for any help.

Before you do ANYTHING, I would go pull your reports from annualcreditreport.com. (I'd suggest getting the full report sent snail mail to your house, that way you have ALL the information and can make photocopies to dispute anything that is inaccurate.) You get one free report from each bureau every 12 months. From there, you can figure out what to do, if the debt is yours or not, how much is owed, how old the debt it, etc etc. Once you have that, you can get a lot more help from us. Smiley Happy

Re: PFD Example Letter

It really is in your best interest to contact EACH collection agency to get the correct account numbers. You want to make sure it is done properly and your letter gets where is needs to go.

Since these are medical, I would google the HIPAA process. That should be able to help you get these removed, with great success! We can't discuss the process on these boards, but I'd google it. Smiley Happy

Re: PFD Example Letter

Oh wait! These are medical. That is wonderful... Medical are by far the easiest to remove with a GW or PFD. It's simply a matter of asking in most cases. Make sure you do not pay these UNLESS they delete.
There is the hippaa process which we can not discuss but honestly.. I tried it, it was confusing and took a lot of time and patience when I simply used a GW and a PFD which removed 27 medical accounts.
Do you have any special circumstances like you were unemployed at the time, or you are now and unable to pay due to lack of income?

Re: PFD Example Letter

I was employed then and I'm employed now. Really I have no idea how those charges even happened as I thought all this was handled through insurance and all I needed to pay was my copays. I have no problem paying these two amounts. The priority is getting these two derogatory marks off my credit report which is the only hurdle between credit mediocrity and excellence.

Re: PFD Example Letter

Also, I found the hipaa process which has been mentioned here - are you saying you did the confusing time consuming process to obtain results? Or are you saying you bypassed that long complicated process and instead did a simple GW/PFD and got the same results you wanted? Please elaborate.

Re: PFD Example Letter

Manimcool-
Where are you at exactly in the process?
Some steps if they are your debt-

1. You have sent debt validation letters.
- validated it is yours.
2. Sent GW letters.
3. Been denied GW by creditors.
4. Send PFD letters.
