Hi there,

 I am in the process of helping my significant other repair his credit history. We are planning on using the pdf letter with the few collections he has on record.  My question is regarding the first paragraph "I am not sure of the account number, as I have never heard from you regarding this account. The account number I have is the one listed on my Experian credit report which omits the last few digits."  This is not true as we have received letters from the CA, so should we still utilize this verbage?  If not, how should we change it?

1. The CA did respond to the DV with a few statements. However, the final amount due on the statements didn't match the CR amount.

2. I'm in MA. SOL is 6year here (based on googling)

 

Based on reading the "Prepaid Legal Services" site, it seems that the total cost (for consultation etc) would still be in the 100s of $. I think I'll send in my letter first and see if I get a response.

I assume I can file a "breach of contract" case with the small claims court if need be?

Im a little confused on the process to validate a neg mark.  I know you cannt remove accurate info, but I had a mortgage loan that was immediately charged off and sent to collections (I think they were an underwriter for the mortgage co).  Anywho, should I DV first and see what response I get back before inquiring about a possible settlement?  Both mortgage loans were placed on my cr in 07 and scheduled to fall off in 14. 

 

-I should mention that the foreclosed mortgage and the CO mortgage are sold to new companies that claim they dont any info on me.

FYI:  Prepaid Legal is only $17 per month for its telephone consults and letter writing.  The only time it would cost 100's is if you are referred to an outside attorney to represent you.  But if you call in and discuss the matter and request a letter be written on your behalf, there is no additional costs.

 

Now, if the letter doesn't work and you intend to follow up or sue, you would then have to employ a referral attorney which would have retainers (at a discount) but would be the 100's.

 

Anyway, let us know what happens.

Anyone know if this letter will work for a collection that I owe on and want to see if i can get it deleted for paying it? The letter starts with dusputing it but I know its mine.

I have to admit, this letter saved me lots of time..  Copy, paste, change of few things, print then mail off...

 

 

There are good things in life that are free, ya just gotta dig for 'em.

Wow! So much info., so little memory left Smiley Tongue So, would this work as a PFD to the OC on a current but closed CCC? I have the money finally to PIF, but want the whole darn thing deleted off my report. Has anyone had success like this with examples I could look at to formulate a plan of attack?

A quick question about PFD to an OC who has the account in THEIR collection department.  Do you still send the PFD letter with the language about the validity of the dispute?

Yes. That language is in there to protect you. If you send a letter acknowledging the debt, then in some states, that can reset the SOL.

 

IMO, if you had the $$$ to PIF if you had to then it is OK to leave out that language. I did it w/ a Verizon Wireless PFD and figured if they tried to sue, then I could always PIF prior to the court date.
