PFD Fail... HELP!

HELP!

 

I just spoke with IC System regarding an old $100 debt from a medical account.  Started by saying that I do not recall the debt being mine, but asked them if I could pay in full in order to have the TL deleted from my credit reports.  

 

The representative said that they would send me a receipt and mark the account paid with the CRA, but that it would take 30 days for it to delete 'once it is shown that it is paid'.

 

This didn't sound right to me, so I pressed for a PFD agreement.  Rep stated that they do not do agreements.  I asked for it to be removed sooner than 30 days, since I knew that they could make changes to the TL at any time since they created it.  Rep said she needed to talk to a supervisor and put me on hold.  At that point, I was transferred to a new representative to get the rough treatment.

 

New representative told me that since I was 'only calling to have the debt removed from my report' that they couldn't do anything for me.  Rep further stated that since I said I don't recall the debt being mine, that she was going to file a dispute for me.  

 

At this point, I broke it down to her and said that I had already contacted the OC and they agreed to take payment.  Told her that once I have that PIF letter from OC, I could have their TL removed since reporting a HIPAA debt is a no-no.  Told her that I was calling them because it was easier than sending a HIPAA letter.

 

At that point, she basically said that they don't delete TLs and she would have to dispute the collection now because 'the call is being recorded and it might be pulled'.

 

How screwed am I now?  Will this re-age or re-calculate the TL?  Should I just pay the OC and try my luck sending the PIF letter to the CRAs?  Did I screw up the Whychat method enough to render it unuseable?  Debt is over the 4 year SOL for California, but I want it removed ASAP to do an auto loan.

The Whychat HIPAA method cannot be discussed on this board you would need to contact its creator for help on it. Personally I would not have told the CA anything about the OC and just made a deal with the OC to have the collector recalled and pay them off in full. The debt cannot be reaged, the DoFD is a date set in stone going forward on a COed account.

Oops!  Didn't realize I couldn't mention that method at all.  From now on, I will think of it as the Voldemort method.  Thanks gdale6.

 

So if I pay the OC, the collection automatically gets recalled and removed?  Or does the OC just tell the CA that it's been paid and the CA updates their TL as PIF?  When I talked with the OC, they just said that they still have to contact the CA and pay a fee.

No it doesnt automatically get recalled and removed the OC has to agree to recall their collector prior to your payment or it will just update to a paid one. If you were to just pay the OC without an agreement to recall then yes it just updates to a paid collection. From what they said they are not agreeing to recall the collector. You can try again with the OC and possibly even try again with the CA by saying you are not disputing anything you are asking for goodwill that the TL be removed after you pay them.

Tried again with CA and they told me that they don't delete debts, and I'm "getting what you deserve for not paying your bills".  

 

Over a 4 year old $100 debt that I'm trying to PIF...  

 

She also said she's "forwarding this on now because you've acknowledged it" whatever that means.  

 

I wish I could pay extra to bypass the #%$!ole department and reach someone reasonable, if not at least slightly empathetic.

That's odd!. I had 2 accounts with I C that were within SOL removed from the cras after 30 days from the date of payment. I did not attempt to validate the debts, settle for less, or anything else that was suggested on another site. It was easier and faster just to pay what was mine.

Unless you get the OC to voluntarily termiante their assigned collection authority to the debt collector prior to your payment, there is no process for deletion of the collection other tnan a voluntary deletion by the debt collector.

 

The CRAs have two distinct policies regardng deletion of collections.

If the debt collector has their collection authority terminated without the debt having been satisfied, the CRA pplicy is that the debt collector must delete their collection.

That policy is to prevent having two collections simultaneously included in your credit report on the same debt.

 

However, if the collection authority is still in effect at time of payment of the debt, then the CRA policy is that the collection should not be deleted.

I have collection with them also. Did  you just pay the bill and they just removed the tradeline? Or did you ask for it to be removed?

Lindel Did you get the answer to your question? After some research, the won't do PFD but they are very generous with reqgards to requests after payments. I did it for my boyfriend and they never responded but a week later it came off. I suggest taking that route.
