PFD input?

I'm working on Accurate Account Solutions for a collection for Wright & Filippis for $98.  My original PFD was responded to without comment (I used the Tuscani one) but simply a photocopy of an invoice from the OC.  I didn't include them in my recent pre-HIPAA correspondence.  I've sent them 2 PFD requests through their website with no response, and 1 via mail.  I'm considering sending them this:

 

I am writing regarding this alleged debt.  This is not an acknowledgment of this debt, but rather an attempt to come to a mutually beneficial resolution of this item on my credit reports.  My proposal is this: I agree to pay the $98.00 by money order, and Accurate Account Solutions agrees to consider this matter closed and satisfied, in addition to deleting this item permanently from any credit bureau to which it is being reported.  If this is accomplished within 30 days of receipt of the funds, it would be much appreciated.  I hope these terms are satisfactory – if so, please send me an agreement to these specific terms on company letterhead signed by an authorized party.  This can be emailed to me at myemail@fakeemail.com via pdf if you wish to expedite this, or at the address above.  Thank you for your time.

 

Does this seem too demanding?  This is set to fall off my reports in September 2012, and is within SOL.  Yes, I have the cash to PIF and that's what my offer was.  I'm considering going against traditional wisdom and actually call them because of the non-responsiveness to date. Should I just scrap this and HIPAA them?

Sounds good to me....from what i am hearing lately HIPAA has no legal backing, so i'm not sure what to think these days! Good LUck!

Rebuilding and Reducing Debt, is my game plan.

If the collection is for a medical debt they have to remove it once it is paid as they can no longer report any medical account unless they are trying to collect on it.  So once you PIF it will be deleted.  If they continued to report after it was paid they would be in noncompliance of HIPAA privacy laws.  They know that.  If you'd like I can PM the direct link to that information.

I'm not saying you're wrong but I've never heard of this or read it anywhere else. Just because it is a medical collection doesn't mean it is automatically deleted after payment without some effort on the part of the consumer.

 

If it doesn't violate the forum guidelines or the TOS why don't you post that link publicly?

Because of the big stink that caused the medical forum to be closed down on MyFico I don't want to post the exact link but you can google "Why Chat FCRA & HIPAA Statutes" to get the needed info.

Yes I'm familiar with WhyChat and the HIPAA process but my comment was in response to your post saying  If the collection is for a medical debt they have to remove it once it is paid as they can no longer report any medical account unless they are trying to collect on it.  So once you PIF it will be deleted.

 

The HIPAA process requires that a consumer do certain things in a particular order for a deletion. There is no automatic removal after a PIF as I thought you were implying. That's all I was trying to say. If I misunderstood your words I apologize.
