When you say 'go before the court', do you mean thetraffic court of the jurisdiction that wrote the ticket>? or is the CA suing you? If it's the traffic court they may be more lenient towards your situation, but I'm not sure if they can prevent it from reporting. If you contact CA you may be ablle to do a PFD.
I would try to contact the traffic court first, eventhough I doubt they can help you- then go for the PFD.
Yes, I was talking about going before the traffic court. I'm going to call them today to see if I have any options. The CA is not suing me. I sent a DV letter and i'm waiting to hear back.
Thanks!
The "court" has no jurisdiction over credit reportiing under the FCRA. Period.
Unless the "court" dismisses their judgment, then IMHO, it is a waste of their time and yours to argue, after the fact, liability for a matter that is already adjudicated.
I dont think that the "court" would even entertain a hearing on resonsibility for debt that you have assumed for a minor child. Do you want to shift the responsibilty to a minor?
I had a parking ticket go into collections as well. Having not frequented the ficoforums, I regrettably paid it off as soon as I saw it since it was a relatively low amount. Currently it's there, paid, but listed as a derogatory trade line associated with my CR. I've been sending GW letters to the CA requesting deletion but haven't received any responses.
I tried disputing the ticket as well, since it was for a car that I hadn't owned in years. (I'd given the car to a family member.) I guess I'd forgotten to have the release of liability filed with the DMV and as the registered owner I was dinged for the parking ticket. No dispute with the DMV, no dispute with the police department and no dispute with the CA. As the registered owner, you basically have very little ground to stand on when arguing against tickets.
Circumstances may differ if princess is over 18, but it may be hard getting anything done with this type of issue. My suggestion would be to start requesting PFD's. If possible, don't pay unless they agree to delete.
