I had a couple of collections with PRA that recently fell off my CRs due to it being 7 years. They weren't calling me for the longest time but now they've started calling. I know they can keep trying to collect the debt but I'm not in the position to pay them anything. Can I send a cease and desist letter or email to get them to stop calling me? Can anyone point me to a template?
If, based on the date of default or last payment, the debt is outside the SOL for collection in your state, you can send Portfolio a demand to cease and desist all communications with you. You could include that your letter is in response to a phone call you received from them on whatever date.
It is not necessary to reference the FDCPA or threaten to contact an attorney if they violate the C&D. It's not your responsibility to inform them of the law or what would happen if they violate the law.
One sentence and it ends,
"Please cease and desist all calls and contact with me, immediately."
Sent it certified mail return reciept. Done.
I have the same problem. Portfolio Recovery has started calls every day beginning a few months ago. My DOFD was Dec 2014. The only difference is that mine have not fallen off my CR

@aviodontYou should file a dispute with both EX and TU as too old. EQ should delete on their own. I'm surprised they didn't drop off already. I'm definitely going to send the cease and desist letter. They're a very annoying CA.

If that's the actual DOFD, then they should be coming off the credit report within the next 3 months or so. Don't expect PRA to remove it early as they will often hold on to the bitter end, lol. But it's about to come off anyway. You could just send them a certified letter in which you identify the account--use the description that they have reported on your credit--and state that you want them to cease all communication with you regarding that matter. Nothing else is needed. Sometimes, I tend to go a bit over the top, lol, but it's not needed.
