I made a dumb decision and decided to file bankruptcy, chapt 13. I am planning to withdraw because it seems far more worst to proceed. My question is regarding Portfolio Recovery. They have multiple accounts of mine totally a high amount. I am wondering if once I withdraw will they immediately seek a judgement againt me or if they are the type of collectors that will allow me to do a payment plan and if so, is it a few months or do they offer plans like 12, 24 or 36 month plans? Any info is greatly appreciated. Thank you
FIrst things first, meticulously check your infor regarding portfolio recovery. I did so, and sent them a letter asking them to "send full validation in the spirit of the FDCPA."
Then advise if proof can not be obtained and forwarded, you expect them to delete all notations of this account to any and all credit reporting agencies immediately.
Mail the letter certified with receipt requested. It is well within your right to ask for proper validation - and for me, Portfolio deleted my collection before I even received the green receipt card in the mail.
Portfolio Recovery is very flexible. Their standard policy is to delete collections from your credit report once the collection is paid. You can pay as little as $5 per payment. In my experience, they leave you alone as long as you have a payment plan in place. And you can pay more/less as you need to by modifying your plan online.
