Question about reporting

back in 2013 I had a jewelery item for around $3000 that went to charge off in 2014(never hit my report), the inhouse collection agency then passed the debt to another collection agency which HAS hit my report all 3, but was never paid so that collection agency passed it back to the original in-house collection agency which i then settled on feb. 19 2016. I have all the documentation of the settlement and the invoice of being paid in writing.

 

My question is the Old collection agency who HAS hit my reports is still reporting a balance as charge off bad debt, would  that need to be deleted since they no longer have it? 

 

also is it to soon still for anything to change should i wait it out?

not sure how it should play out or what my next steps are?

Yes, if you paid a different collection agency than the one reporting, then they did not have collection authority at the time it was paid and their report should be deleted. Dispute with the CRA's with a comment of "Collector did not have collection authority at the time the debt was paid"

thanks norman, would it be wise to also upload the documentation or should i just dispute? also what if i disputed that agency on my report recently

As I understand the scenario, you eventually paid the original crediitor via their own in-house collection department.

An in-house "collection agency" is usually not a debt collector under the FDCPA/

There was prior reporting by a third-party debt collector, and the issue is whether the third party debt collector's reporing can now remain?

 

If that is the scenario, the answer is that it depends.

It appears from the facts presented that the OC never sold the debt, and thus any third=party debt collectors only had assigned collection authority.

CRA policy is that reporting by a debt collector should not be deleted if they had active collection authority at the time the debt was paid, but that they must delete their collection if their collection authotity was terminated prior to payment of the debt.

 

From the facts provided, it depends upon whether the OC actually terminated their assigned collection authority to the reporting debt collector before you made your payment.

Since the reporting debt collector did not close their collection, they have never reported that their collection was terminated before payment of the debt.

before i paid anyone i did alot of research (debt validation from the non reporting inhouse-CA) and called the CA that has actually hit my report.

They said they have no longer had collection rights and passed it back to the in-house collection, so after that i then paid the settlement once i got in writing.

Then I agree with Norman.

The collection should have been deleted by the debt collector when their collection auhority was terminated.

Contact the CRA and request its deletion on the basis that the collection authority was terminated prior to discharge of the debt.

i recently just disputed on feb.20 how long should i wait to dispute again? its already been completed but nothing happen.

When you say that you "disputed," do you mean that you sent a DV request to the debt collector, or did you send a dispute of accuracy of the reported collection to the CRA?

 

If you disputed with a CRA, they have 30 days from the date of your dispute to conclude their reinvestigation, and five business days thereafter to send ther formal Notice of Results of REsinvestigation, which is the formal document that concludes the dispute and presents their results.

 

A dispute filed on Feb 20 can take until the last week in March for mailing of the Notice.
