Question on when collection will fall off?

I have a TU report from TU website and I have two accounts that WERE DUE TO FALL OFF IN 9/2009.  On report it says estimated date this item will be removed.  I am not sure if I should contact the CB and see if I can have these removed. What would be my best option?

When is the last time you pulled your free credit reports at www.annualcreditreport.com? They will give you more complete information than from a third party site. Experian and Transunion will list drop off dates for your accounts. These two accounts may have already dropped off.  In my experience they should be gone as of the date listed. That's my advice.

I had pulled my credit from www.annualcreditreport.com earlier so I am not eligble to repull.  At the start of this month I had paid to pulled and pid for my reports from myfico.com.  They are still on the report.

Sure Contact TU and ask them when these collections are due to fall off your CR. And when they say sept2009. humm tell them its november2009.

I would be very interested in there reason for the delay. If you call them, do share with us what happened.

Should I Only contact TU or should I contact all three CB's.

Hi,

If you have a hard copy of the report with the "fall off date" then circle it and fax it in telling them to remove. I did this with Experian, they had a baddie account report in the middle of the month, faxed in a copy of my CR, circled the statement "due to fall off" and it was removed. FAST.

You would need to contact each bureau IF the collection is report with all bureaus. Not all collections report with every bureau, some do. But again, you need to get current credit reports before you start to dispute. maybe it already fell off.

I have new CR i just pulled them a little over a week ago and they are both still on there. Thanks I will fax them tomorrow.

Fall-off date for collections is not governed by what it is in your CR, it is governed by the date of first default with the original creditor.

It is set under FCRA 605(c) as 7 1/2 years from one date certain, the DOFD on the OC account.

The original creditor must, under FCRA 623(a)(5)(A), report the DOFD to any CRA with which they have previously reported to.  They must do this within 90-days after reporting.

This reporting is not a common thing revealed in normal consumer credit reports.

 

How to find it, with definity?

Write out a check for $10.50 payable to the CRA, with the attached letter:

 

"This is a request under FCRA 609(a)(1) for a disclosure of all information in my credit file that pertains to the reporting of the date of first default by the original creditor, (name).  This information must be in my credit file, for it was required reporting by them under FCRA 623(a)(5)(A). 

"If clarity lacks regarding my request, this may help.  This information is typically coded as the FCRA compliance/Date of First Delinquency, in Field 25, Base Segment, of my credit file, and regards any posting made to you by the creditor under the Credit Reporting Resources Gude, (c) 2006, CDIA.

 

"This request additionally includes the disclosure of the date of first default reported to you by the collection agency, (name), regarding this account.

 

"I additionally request, under FCRA 609(a)(2) that your response include a disclosure of the sources of all information used in your response to this request.

 

"I recognize that this request requires a fee of $10.50, under FCRA 612(f).  My check is attached to cover this request.  Your prompt reply is urgently needed

 

"Sincerely, (you)"
