Ok -
I have a $33 charge off from Verizon Wireless. I owe the money but I didn't know about it until I recently pulled my credit. My GF and I consolidated our cell phone bills (she gets a discount through her employer) and when we went to the VZW store I was under the impression (because I was told by the sales rep) that my account and bill would be switched over to her. I still have the same phone number for God's Sake.
So I sent a PFD to VZW and they respond with a letter saying call between 8-5 M-F to talk about your account. I just called and spoke to a rep who said that my account has been sold to CBCS and gave me corresponding phone number. I asked her if there was anyway that I could take care of this with them and she said no and cold rolled me to the 800 number of the CA.
I'm seriously thinking about going to the Contact Us links on the VZW homepage and firing an email at an exec. I'm pretty pissed off.
My credit report shows I can screw up my stuff just fine on my own, I don't need any help from VZW.
ETA:
VZW shows a balance and is reporting as a charge off.
There is nothing about CBCS Financial anywhere on my CR.
If they just sold it, the CA may not have had the chance to report yet.
I have read good things and seen good results from using the letters composed on Planetfeedback. You can try it and see what happens.
Can you (or someone else that reads this post) explain the Planet Feedback to me? I don't know where to find the part that goes to the letters. Everytime I go to that site I find that it's two hours later and I've been reading letters directed to Subway about the not getting enough black olives e.g.
I have never used it but I will go see if I can figure it out.
Right hand side on homepage, Write A Letter in purple. I'd personally click on the I Have A Question option, then start typing for Which Company. I don't think you have to leave that screen until you click to submit it. Oooh, and send it only to the company, click the option to not show on the site. Otherwise you will get comments.
It took me awhile to figure it all out. I got lost reading about this one woman who had her kids screaming wanting chicken nuggets and Mickey D's was out of them that afternoon, and she was mad. It was so funny....The ones I sent ended up being to companies out of business. Good luck! It may work for you! :-)
If the OC has sold the debt to a CA, they no longer own it, and thus cannot accept payment, with or without collateral PFD issues, on a debt that they dont own.
The OC reported it as a charge-off, which means they have already recouped a portion of the debt owed to them via a tax writeoff, which requried them to report it as uncollectable debt to the IRS. They sold the debt to a CA. They are kinda done with the account on a legal basis.
If, and when, a CA reports, then you can only have ownership of the debt reported by one creditor. So, at that time, the OC will have to update the status of balance on their CO to $0, shifing it over to any subsequent reporting by the CA.

So laymans terms I'm kind of screwed until the CA shows up? Should I DV the CA VZW referred me to or wait to be dunned?
That about sums it up.
You cant DV a debt collector under FDCPA 809(b) until they have made initial communication wth you.
Until you have some sort of initial commnication from the debt collector.. either in the form of a phone call to you. ;letter to you, or posting to your CR, then they have not iniated any "initial communication" with you that requires a dunning notice umder FDCPA 809(a), and thus give you any DV rights under FDCPA 809(b).
So I was going through some papers tonight and I found that apparently I was dunned by a CA about this VZW account in Oct 09. Since they aren't reporting should I PFD them?!?
