Question reguarding PFD with IRR, please help

So I finally got some money together to pay my last few baddies and have them removed from my credit, these are all from 2/11 - 6/11 DOFD, my biggest one is with Independent Recovery Resources for 1795, I called today to try and negotiate to pay less and have it deleted from my credit.  Now I am confused as to what is going to happen if I proceed with what they want me to do.  They said if I paid in full by the 20th of this month they would delete it because I am stating I do not believe it to be my debt, but they want me to write a letter stating that and send it in with certified funds to have it deleted but will not give me anything written stating they will delete it if I pay.

I told them I didn't have that much and I was willing to pay 1000 to have it removed so I don't have to deal with it and just have it gone.

 

After trying to get me to pay half this month and half next month I said I would not do that because I have been screwed over in the past making payments.  Basically she said that it is about to be sent to a lawyer for a judgement and if nothing is done today she probably wont be able to stop it.  Then tells me I need to write an email to them stating the account number and I do not believe it to be my debt however I am willing to pay $1000 with certified funds to have it deleted from my credit report, after I email that she will call her client and see if they are willing to settle it for that much, but probably not they will only probably take 20% off. 

 

Basically I am asking what do I do from this point, does me emailing that stating I do not believe it to be my debt and I am willing to pay 1000 to have it removed put me in any bad position?  I have the new york 5 year rule which I believe is 5 years from DOFD if I pay the debt I can dispute and have it removed for that law I believe I am still doing a little more research on that as well.  I am sorry this is rather jumbled, this is just the first thing in my credit recovery that has me a little worried, threatening a judgment and lawyers on me when I am a few months away from trying to purchase my first home.

Debt collectors sign credit reporting agreements with the CRAs.

One credit reporting policy of the CRAs is that they agree not to delete based on payment of the debt.

That is a CRA policy intended to serve their business purpose of maintaining as much info in their credit reports as possible, thus maintaining the value of their reports.

 

With that as background, I view their request for an additional statement of debt not mine as a way of then basing their deletion upon an additional consideration other than simple payment of the debt.  It is likely over concern that they could lose their credit reporting agreement with the CRA.

i would not put any such sttement into a sworn police report, but I would not hesitate to simply state that you dont acknowledge the asserted debt.

That could broadly be only a statement that you dont accept the full amount they are trying to collect.  Something to give them what I view is their "out" from simply granting a blanket PFD.

Just to update since a lot of what I read about questions and such doesn't get updated with results, I spoke with someone else about this with IRR through email back in Feb. and had emailed her again that day.  She had sent me an email with all her information on it stating what I asked for upon paying 80% of the debt that day they would submit for deletion from all the bureaus.  I mailed the certified funds that day and the day after they should have received it I emailed them saying they got it and requesting the proof of deletion we had spoken about.  They promptly emailed me back with an AUD control # saying it should be deleted within 48 hours and if I had any issues to call the bureaus with that control number and it will be deleted if not already. 

 

Today I contacted my last actual collection account which is oddly located 10 minutes away from my work, spoke with them and they agreed if I came in today and paid the amount they would submit for deletion right then and there as well as provide me with a letter stating that just in case the bureau was to not follow through or get backed up.

 

Next week hopefully I can get rid of my last baddy, a charged off First Premier card that is scheduled to fall off 3/18, which I will make another thread about right now with a question. 

 

It has been a long journey from the 535's I was in September to the low 700's I am right now before the deletions have taken place, I can see myself moving into my first home by this fall or spring at the latest, thanks to the information I have learned on this board and dedication to saving money and spending wisely.
