My husband and i are in the process of applying for a mortgage. I received a call from the bank today asking me about a paid bill that I disputed. It was a medical bill and months ago I sent them a dispute siting HIPPA. Which I won't discuss. Anyway, for the mortgage company having anything disputed is bad. So I call the Collector and asked if they would remove the dispute and write me a letter saying that it was no longer being disputed. They said they had no record of it being disputed and no they would not write such a letter. So now what do I do???
...ask the CRA to remove it
Did you file a direct dispute, or file it with the CRA?
I filed the dispute with the Collection Agency. They say I didn't and it hasn't been disputed. So they won't write a letter saying its not being disputed. My Banker says by law they have to. I have dealt with this Collection Agency a few times and they are jerks. Local place. Can I file a complaint against them?
...if you filed the dispute using certified mail/rrr and you kept the delivery receipt, yes ...but it probably won't get you anywhere
...if the dispute is on your CRA file then file a verification request with them stating the debt is PIF and no dispute exists ...the CA has 30 days to reply to the CRA or they remove it
It appears that the "dispute" did not cite FCRA 623(a)(8), and thus was not considered by them to have been a direct dispute under the FCRA.
Since you reference HIIPAA, was your "dispute" related to privacy of medical information rather than an inaccuracy in their credit reporting?
If you did not file an actual direct dispute, and the debt collector did not report a pending dispute to the CRA, that may fully satisfy your mortgage lendor's inquiry as to the "dispute."
