I replied back to the BBB to close the complaint. Filed with the CFPB, and uploaded copies of my CRs. No formal response back yet on the CFPB website, but received a letter in the mail yesterday. They are closing the account and requesting removal! No mention of not selling, but I'll deal with that if and when it happens.
I'm down to 4 collections from 8. 2 Midland (1 still within SOL till Nov., working on the other one.), LVNV (Will work on a PFD next year), and one other that's only on my EX report. Hope to have it paid by years end.
My idea is to make them prove what they say. PRA was easy because they were reporting false information. 3 of the collections were removed via the CFPB. My complaint was they offered zero proof of the debt, zero proof they were authorized to charge interest. In some cases, you may need a judge to force them to prove it. Maybe I've been lucky, but so far, I haven't needed one. If they send you a copy of the original contract, great. This proves they can charge interest, nothing more. Remember, the burden of proof is on them, not you. When you get that response letter from a CA asking you for documentation, ignore it. You don't have to provide them with anything. Unless of course its been paid and you can prove it. As always, YMMV, but this is working for me.
On using the BBB. While I was able to get one resolved this way, I think its best to go directly through the CFPB. (Thanks guiness) Cut out the middle man. For those of you within your 30 dunning window, get that DV in the mail ASAP. FDCPA 809 is key on this. Again, maybe I've been very lucky since all of mine are years past the 30 day window, so just because your outside those 30 days, it doesn't mean your stuck.
