Re-aging question

I noticed on my EX report that a negative account was listed as a charge off in April 2006.
Due to my ignorance of credit rules/laws I disputed the account (for really no reason). I realize I was wrong and should dispute legitimate issues.
My problem is my account is being counted as a new charge off and the drop off date changed from 2013 to 2018. Is this an example of illegal reaging?
Is this grounds for deletion or just change back to correct reporting?

Thanks
Brad

Re: Re-aging question

I would dispute based on the DOFD.

Re: Re-aging question

Not too hard to establish improper reaging of a charge-off.

The credtior is required, under FCRA 623(a)(5), to report the DOFD on their account to the CRA within 90 days of having reported a charge-off.

So it must be in your credit file.  The CR exclusion date is based only on the reported DOFD.

If your CR does not provide the actual DOFD reported by the credtior, you can obtain that date from the CRA simply by filing an information request under FCRA 609(a)(1), along with the required processing fee, which is currently $11.00.

Compare that reported date with your actual account history.  If not accurate, file a direct dispute with the creditor for inaccuracy in their reporting.

No inaccuracy in reporting is a required grounds for CR deletion.  The furnisher of the disputed information always has the option to corrrect the information so as to make it accurate.  FCRA 623(b)(1)(E)(i).  Deletion is only compelled if they cannot verify or modify the accuracy.
