Received Letter from CBCS collection agency

Hi All,

 

I recently received a letter from CBCS Collections regarding a debt owed on a utility bill. I thought that I had set up auto-payments at my old residence (when I lived there), but apparently it did not work, so I had past due debt from October-Jan (when I moved out). To complicate matters further, my landlord told me that she contacted the utility company and put their name back on and took me off once I moved out (at the end of January). However, it turns out that she did not do this and that my name is still on the account.  Additionally, I called the utility company on Friday after being called by CBCS and was told by the utility company representative that it had not yet been sent to collections. Today, my fiancee (who we didn't think we put on the account, but I cannot confirm this with the utility company until Tuesday) received a letter from CBCS saying that the "debt had been placed with this office for payment." The letter had the correct name of the utility company and our account number for the utility company.  Does this mean that it will be reported to the credit bureaus and end up on our reports?

 

My main concern is keeping this off of our credit reports, so I would rather just pay all of it and then get the money from our old landlord afterwards (she is slow about getting anything taken care of). After talking to the utility company Friday, I went online and paid part of the debt (the part that I owed from Oct-Jan), which upon reading further on here may not have been a great idea. Does the fact that I was still able to make the payment on the utility company website indicate that the debt has not yet been given to CBCS?

 

How should I proceed? Do I call the credit agency to see if they own the debt or do I call the utility company and ask if they still own the debt?

I have credit monitoring through Experian and Equifax and pulled my reports yesterday evening. The debt collection did not appear on the reports, but I was unsure if it just took some time to show up.

Is the "Original Creditor" reporting on your files?

The newest accounts that show up on my credit report are my student loans, which started payments two years ago). Is there somewhere else on the report that I should look? Sorry for not being sure where on the report to check for this info.

Okay, no problem. We are here to help. You said that the collection agency is now collecting for the utility company, correct? Has the utility company reported your deliquent account to the credit reporting agencies?

CBCS said that they're collecting the debt, but the utility company customer service rep with whom I spoke on Friday said that the debt had not yet gone into collections, so I was confused as to which is true. CBCS has a bad reputation (both in some posts on MyFico and on other places I've just found online). Nothing seems to be showing up on my Experian or Equifax reports from the utility company or CBCS. Thanks again for the help.

Call the utility company and ask them to pull it back from collections or to prevent them from sending it into collections. Ask them to agree that if you pay in full that they the original creditor will not report.

It's obvious the collections agency now has it by the letter they sent you. Talk to the utility company and beg them to pull it back from collections.

You should be prepared to pay it in full.

I am completely fine with paying it in full immediately. Do I need to ask to speak with a supervisor at the utility company? Also, since I already made some of the payment through the utility company website, then will they take that money without it counting against paying the debt?

Not at all. Whatever amount you paid will be applied to the account. You can ask to speak to a supervisor.

The goal is to get them to pull it back from collections, get them paid and avoid reporting.
