My husband had a credit card with Chase that was charged off in October of 2008. It reported on his credit as a charge off until July 2010 when it was sold to a collection agency, CACH LLC. and reported on his credit as closed. The collection agency sued my husband and won. From March 2011 to Feb 2012 his wages were garnished for a total of $7900.
Yesterday, we recieved a check in the mail from Square Two Financial Corporation for $7900. There was no check stub or any paperwork in the envelope, just the check. The check said it was for a "Trust Controlled Disbursement", and after Googling Square Two Financial my husband was under the impression the check was payment from a trust his mother set up before she passed away a year ago, so he deposited the check. This morning he called Square Two Financial to find out for sure what the check was for. Going through the automated menu to try and talk to someone, he was transferred to a voicemail for CACH LLC. Apparently Square Two Financial owns CACH LLC. As soon as he found that out, it clicked in his head that the check was the same amount that he paid in garnishments to his check.
My questions are: WHY did we recieve a refund check for the amount of the garnishment? We have not had any contact with CACH LLC since they sued my husband. When he called this morning, he only went through the automated menu and didn't speak with a real person. Should we contact them? Should he have deposited the check, or is this going to cause us headaches later on? I'm really confused! We're in California if that makes a difference for anything.
I would create an immediate paper trail of attempt to resolve the issue by sending them a letter, CMRRR, asking about the check.
That will demonstrate that he had no intent to deposit funds not entitled to, and is pursuing the issue.
