I was told that OC or CA are now unable to delete anything from your credit report (unless it's wrong).
If you send a GW letter, are they ABLE to have it deleted?
I was told to ask for a letter of deletion when I paid my bill off and when I did, I was told by several CA that they were not legally able to do so. (of course, they aren't known for always telling the truth).
I am just started to get knee deep in my credit report. We are hoping to get a home loan before Dec 1 so we can
benefit from the $8000.00 tax credit.
My husband has 34 negative items on his report, but many of them are the same bill listed 2 or 3 times from OC to CA to CA....is there any way to get one or more of them removed?
I have been MORE than confused trying to figure out who is who and who we owe what..has anyone come up with an easier way to organize the list to make sure we don't miss something or double pay something.

I did edit it to change the subject, but not the message.
To answer some of your questions.......
No one is required to report to the CRA.......the only requirement is if they do report, it must be accurate. So, technically a OC or CA can have something removed. Their agreement with the CRA is that they won't unless it is wrong. Some will use this as the reason, but say they legally can't.
As for the same debt being listed more than once......the OC and 1 CA can both report. More than 1 CA can not report the debt at the same time.
I did a spreadsheet in Excel when I began. The colums were like this......
Original Creditor Collection Agency Amount DOFD Within SOL Last Reported Date
The first thing I worked on was inaccurate information and items beyond SOL.
For accounts reported by more than one CA, I looked at the last reported date and date opened. This gave me a good idea of who had the account first and who had it last.
Thank you so much for helping. It's is completely overwhelming to me! I do have a spreadsheet going but with each item, I will change the columns so the ones you suggested.
I feel like once I get a handle on it, something else confuses me.
For example, Arrow Financial is listed once on my CR. I called them to see what the bill was and they said they had a total of 5 accounts under my husbands SS #. They started to rattle off to me each of the bills and were they were sent. When I called some of those CA they has sent them to other places. I made settlement arrangements with all of these places. So later I call another place about an account that is paid but still is reporting "charged off" by the OC, I was hoping to get that changed to paid (no idea if that's possible, another confusing part for me).
When I call the OC they tell me that it's been sent to Zenith (I think that's the name) so when I call Zenith the jerk...with a capital JERK tells me that he'll send the receipt for payment and that we have another account there.
When I asked him what it was he told me and I said I've already talked to someone about that account and he yelled at me that I haven't....blah blah blah...he said if I had he would know about it. So I asked where the account was and he told me I had to call another number to find out where it was....I do that and was told it was at a Lawyer's Office which is EXACTLY who I'd already made the settlement arrangements with....
It is INSANE!!!!!!!!!!!!! Some of them are really nice and some of them are HORRIBLE!
Let me add one more question.
My husband voluntarily surrendard a truck he was leasing in 2003. They sold the truck for $9000.00 less than he owed (apparently) and now we have that amount on our CR. Chrysler has it listed as paid/closed and under account history it says "Voluntarily Surrendered as of Aug 2003. 30 days past due as of Jul 2003.
It was turned over to collection or bought, I don't know by Palisades Collections and it's listed as Date Opened 02/2007. Last Reported 04/2009 Recent balance $9,265.00.
It says it's scheduled to continue on record until Apr 2010.
They said we are going to need to have this paid before we can get a home loan and we were hoping to get one before the Dec 1st deadline for the $8000.00 tax credit.
Should we try to get a settlement or should we wait it out? Any suggestions?
Hi molyneux, There are some things that you need to know before touching your CR.
Never, ever talk to a CA!!
You need to know the DOFD of the debt. This is set by the OC not the CA.
What is your SOL?
If you are past SOL then mail a DV CMRRR to the CA.
Most will accept a PFD when you are past SOL. They might accept a PFD for part of the total amount owed. BUT never pay 1 dime without a PFD (if past SOL)
Always send a DV before thinking of paying anything!
Take your time and do 1 thing at a time. You will learn as you go. I tried to do my CR and DH at the same time. I almost lost my mind.
Look at the CR from 1 CB. See if you can match an OC with a CA by name or amount. Then do the same with the other 2 CBs.
When you have more then 1 account with a CA,you can mail the DVs together but write separate DVs for each account.
You say that you made settlement arrangments with someone. Did you pay yet?
If you are in SD and the car was leased in SD then the SOL is 6 years. The reporting by the OC makes the drop date of April 2010 sound good.
Make sure that you keep hard copies of all 3 CBs forever.
Mail a DV CMRRR to Palisades. They are known to update every month until CRTP
The debt would have been bought or the OC would report a Bal owed.And they bought it for pennies on the dollar.
Send the Past SOL along with the DV.
When a CA is assigned or buys a debt they will report Date Opened. this means only that this is their first report date.
Do NOT sign it just type your name.
I have not paid any of the accounts. I have given them my account number to do an auto check at the end of the month. I opened a seperate checking account to ONLY use for this situation. I know, it was probably stupid, but
I'm feeling like I need to get this done ASAP to get the loan process going!
(I will sit here patiently and wait to be scolded, I know I deserve it).
The SOL in our state are:
Oral Contract: 3 years
Written Contract: 6 years
Promissory Note: 6 years
Open-Ended Accounts: 6 years
I have disputed most of the account online. I got several of them deleted, a few of them are pending and a few were kept on the report. I have no disputed the truck as of yet. I'm assuming the SOL means that is only how long they can sue you, but as far as the CR they can keep that on for the full 7 years, correct?
I will certainly send the SOL DV letter (I'm assuming there is probably a sample letter on this site).
Should I send DV letters to everyone else also (including the ones I've already done online and were not removed). I will look back to the SOL date on the rest of the accounts also!
Thank you again for all of your help. I will take things one step at a time. Maybe I can get one report done per day and still try to stay on track for the morgage!

All these items you made settlements on......are they reporting? If not, did you get an agreement for them not to report? Are they too old to report by chance?
Arrow is a CA....so who did they send the accounts to? If they sold them, they can't collect or report.
As for the OC reporting charge off......only the OC can change the reporting. Does it show paid or a $0 balance?
Is Zenith reporting either account?
Are you keeping good records to make sure you aren't double paying since you are dealing with so many CAs?
Have you DV'd any?
If you want to take the time......list the debts(like debt 1, debt 2, etc) and state who you called and who they referred you to, and who you made the arrangements with, and who(if anyone) is reporting.
As mentioned, I would stop calling CAs. I would also opt out with the CRA.

SOL on this may not be expired yet. Check state statutes to determine exactly when SOL begins running. Also check to see if this falls under UCC SOL instead of written contracts, as auto loans do in Missouri.
Even at SOL of 6 years, if you were just 30 days late in July, then SOL could maybe not expire until end of July 2009.
Don't do anything until you know exactly when/if SOL has expired. You don't want to end up sued.
