Retribution for dispute? First Progress Issues

I need some feedback on if I'm being paranoid or if this is some sort punishment for me disputing the account.  The account was a First Progress charge off from 2013. In an effort to raise my scores I paid off the balance of $142 in January. When the account updated in late January it reported as paid but moved up the date of the first delinquency to 2016. Of course, this is not ok so I disputed it and said the correct date was August 2013. 

 

Literally less than two days later I get a notification that my dispute has been resolved. At the same time, my credit score dropped 13 points. First Progress updated to the correct DOFD to August 2013 and hit me with a failure to pay for March 2018! This is absolutely insane, the account shows as closed and paid in full. I disputed the failure to pay and I'm waiting on the result. Could they be trying to punish me? Is there some petty person at First Progress?!!

I cannot comment on their intent at any retribution in reporting a delinquency after you paid the debt, but you clearly have basis for disputing the accuracy of that reporting.

 

FCRA 623(c) protects furnishers from private civil action by consumers asserting willful or negligent reporting of inaccurate information.

Rather, it requries that you first file a dispute of the accuracy of the reporting, providing the furnisher with the opportunity to correct the reported inaccuracy before you can take an civil action.

The reported delinquency was not an inaccuracy identified in the prior dispute, so a new dispute is needed to obtain a reasonable investigation of that inaccuracy.

If you dispute the accuracy and they verify it as correct, that will then permit you to bring civil action for lack of reasonable investigation of your dispute.  

 

You should first file a dispute and get a resolution of either deletion or verification.

If they delete, your problem is solved.

If they verify, it opens the door for filing civil action.

I just had something similar happen to me with an old car loan from Heights Finance.   I had some late payments that should drop off, but haven't so I disputed.   Not only did the late payments not get deleted but they added for for the month I paid off the loan.   The final payment was two week prior to the due date and I was current at the time.

It is so frustrating to pay something off and have a negative outcome!

I'm still waiting to hear on the disputes from the other two CRAs.
