SOL question

What would be the SOL in these two situations:

 

1.  SOL in Virginia for medical services (phy therapy clinic, not hospital)... how many years from date of service?

 

2.  SOL for utilities (electric).  Bill is from FL (2004) but I moved to VA in March 2004.

Written contract is 5 yrs for Virginia and FLA  also.

 

I dont know if there is SOL tolled laws for FLA. Would have to check FL SOL laws for collection of debts.

SOL will go by the state you currently live in.  Even if the SOL in the other state tolls, you would have to move back there for it to start again.

Thank you both for the replies/info.  What does it mean if the SOL tolls?

 

What does a debt for services, i.e. cable TV, fall under?  Would it be considered a contract too?

It means the SOL time period starts all over again.  So if the SOL is 4 years, you now have to wait a brand new 4 years.

Utilities Collection Success!

The CEO of Clay Electric (FL) was ignoring my e-mails so I e-mailed the division/area manager yesterday.  I received a call from their collections department (no CA involved, their collections are managed internally).  They have already sent document to the CRAs to delete the TL - the very same day.  They also admitted they made a mistake when they sent two checks weeks apart in 2004 (they should have only been one check). 

 

In my e-mail, and again on the phone today, I told them that when I see the TL off of my report, I will send payment of $53.85 but not until the TL is gone.  They immediately  faxed me the document that's sent to the CRAs to have the TL deleted - and they faxed me a letter admitting their mistake.  As I told them in my e-mail, the debt (even if valid) is out of VA's SOL, so the TL will come off of my CR next year if I do absolutely nothing.  I also told them in my e-mail that I had no intention, whatsoever, of paying any bill unless it disappears from my CR.

 

FICO should go up again after this collection disappears.  Only baddies left are two medicals... one small, one $600ish.  I hope to have the HIPAA process take care of those and have those disappear within the next month too!

 

Utilities collection - GONE

 

Cable collection (two TLs, same instance, one for bill, one for equipment) - GONE

 

Woot woot!!!

In states that do not have a specific SOL for medical debt, and there are only one or two, then, yes, they fall under written contracts.

I'm confused. If there is no specific SOL for medical debt then in theory a consumer could be sued decades in the future.
