Hi  I was wondering if anyone has a sample DV letter i can use?

Actually, there are several archived in this forum. Just use the search feature right at the top, "DV Letter".

I tried several searches on DV letter.  I found one sample.  when i use the search it gives me forums about DV letters.

i can try to google it.

That is where i found the one sample letter.

I just thought is would have been more than one.

 

I have spend over a hour searching for DV sample letters.  i wish it was a little easier. I spent more time looking instead of writing them.LOL

IMO, the one provided in LilMirth's link is the best. Many of these, including the one in my example, are so commonplace that I bet the CA laughs each time they see it. By law per the FDPCA, all the CA has to provide is the OC name, contact info, and amount owed. All the other stuff claimed in the letters doesn't generally have to be provided by law. Now each state law varies, but in most places stuff like registered agent info, license numbers, org. documents, etc., don't have to be provided.

So much depends, in any DV request, on factors that are quite different.

That makes canned letters hard to produce.

Did the CA provide dunning notice?  If so, what was the date of "initial communication with the consumer," and thus was the notice provided within the 5-days mandated under FDCPA 809(a)?

Was their "initial communication" with you a formal dunning notice, or just a post to your CR?

Did their dunning notice set forth the amount of the debt, the name of the original creditor, and set forth the "mini-miranda" rights to request verification of the debt within 30-days?

Was your DV request filed within 30-days of proper dunning notice?

Does your DV letter specifically deny the debt?

What are you requesting in your DV letter?  Many do the "full media verifiation" approach, which goes just an inch short of asking them to tell you their shoe size.  All your DV can request under the four walls of FDCPA 809(b) is that they obtain "verification of the debt," and the name and address of the original creditor.  The term "verification of the debt" is not defined in the FDCPA, and thus what you can seek in compliance of this "verification" is a matter of interpretation.
