Santander Dispute

In Sept. 2016 my car was totaled but I had insurance and GAP insurance, unfortunately I had to defer some payments and was told that those payments would not be covered. This left me with a balance of 4,086. Is there any way I could get this removed? Since Mar 2017-May 2018 it has reported late or charge off.

 

This is the current status:

TransUnion- Charged off as bad debt

Experian- Unpaid balance reported as a loss by credit grantor

Welcome to the Forums OP. You're best bet is to pay the debt off to the original creditor. That would be the easiest way to clear the debt. Once that's done, if it's not removed, then you can send GW letters to the OC to have them remove it. If it's been sold to a debt collector, see if you can have the OC recall the debt for full payment. If not, then speak with the CA and see what options you have available. Ideally, a PFD is best as you can leverage that.

I assume Santander is the original creditor, and there is no debt collector?

 

As for "getting it removed," do you contest the accuracy of the asserted balance due, or is your only issue that any adverse reporting be removed from your credit report/file?

A dispute under the FCRA would require identification of an asserted error, and explanation of how the reporting is considered inaccurate.

 

If the reporting is accurate, there would be no basis for dispute.

You could send a pay for deletion offer, which agrees to pay amount $x in exchange for their agreement to accept that amount as discharge of the debt, and to delete the adverse reporting or their entire account.
