Hello all I apologize for the long post and I appreciate any insight you may have.
I financed a vehicle through Santander in August 2013 for $15K @Anonymous.23% for 72 Months and paid $357 a month on it for 3 1/2 years, but defaulted on the loan and it was repo'd in 4/2017. Before I defaulted I attempted to trade it in a my payoff in late 2016 was around $14K! My principal only went down $1,000-$2,000!! At that point I gave up and let them come get it.
Since then I've been ashamed to even check my credit, but do to a new job I've been thinking about buying my first house so I started tracking my credit again. I noticed Santander didn't report the first 2 years of my payments!! I also noticed that they claim the loan was for 80 months and not 72. They are reporting a charge off for $9K and my car was worth around $6K when it was sent to auction. Deville Assets shows a collection of $7,800.
I recently found out about this 34 state $550 Million Class Action Lawsuit and I'm not sure if I will be covered, I sure hope so, I live in FL which is one of the states. In the event I'm not covered, I want to contact Santander and ask them for documents stating What I owed at the time of repossession and what they sold my car for so I can try to build a case on my own. I'm afraid to call and restart the clock on my 7 years, I have 4 left. What should I do?
The max 7.5 yr reporting time cannot be changed its a set in stone date. You should check your states SOL to see how long a written contract can be taken to court before doing anything with them.
I assume you're referring to the 7-year credit reporting period? The 7-year reporting period is based upon the date of first delinquency that led to collection and/or charge off. Once an account has been charged off, that date cannot change. Contacting the creditor would not change that date.
