I have a question about being served with a summons to appear in court regarding a lawsuit from a CA. Would that be on record in the Sheriff's office or on the Clerk of Corts page, what if a CA claims they served you but there is no record of the summons being served? Thank You for any response.
If false, it would be an explixit violation of the FDCPA.
See FDCPA 807(9), (10), and (13).
If they claim theyserved you they would also have the information, as it wouldhave been givento them. Which govt office served you, where, date and time.
I just went through this with a company that said they were on their way to serve me an never showed. They reported on my credit report and I filed a complaint with the BBB, CFPB and my attorney sent them a letter and they responded that they are closing my case and removing all from my credit reports. If you can't get ahold of them and they can;t give you the details file a complaint against them. Good luck to you!
Contact the court clerk's office (look at your summons to make sure of which court to call) regarding service. Be sure to appear in court on the court date, if you let it go uncontested a default judgment may enter.
First thing to do is look up the service requirements for your state. Some states, like California for example, require personal service, while others allow service by US registered mail to "last known address".
