Sprint Collection should I PFD?

On my Equifax CR I have a collection account from Sprint for $361. The Date of Last Activity is Jan. 2008. I am thinking about doing a PFD. Is that a good idea?

 

There is no contact info for this debt listed on my CR, do I just call Sprint and ask for the collections department??

 

Leah said to contact Sprint if the SOL has expired (which I am pretty sure in AZ is 6 yrs) and ask for a recall.  What is a recall and is it better than sending a PFD letter?

....Call Sprint. Talk to them. If they still own the debt and just hired a CA to collect, you can still pay them. And avoid the CA interest fees. You can also negotiate a "recall". Pay Sprint, and they'll pull from the CA. Resulting in a removed collection on your reports.

You need to first know three thngs about the debt that is now under collection.

First, who owns it, the OC or the CA?

Second, what is the DOFD on the OC account?

Third, what is your state statute of limitations on this debt?

 

Item one is the least significant.  It tells you who you can pay.  If the OC still owns the debt, you can pay either.  If the CA now owns the debt, you could only pay the CA.

If you pay the OC, there is no provision for them to "recall" the prior credit reportng done by the CA, and thus wont compel any CA deletions.

A recall is only, in fact, notificatiion from the OC to the CA to terminate further collection activity.  It in no way compels the CA to "recall" or delete their own prior reporting.

 

Items two and three work together.  Item 2 establishes the normal 7 1/2 drop off of the CA, and usually also the running of your SOL.

If your SOL has not expired, then a PFD becomes a bit of a peril.  They may decline or ignore it, and just bring legal action.

No one can tell you from what you have posted so far whether or not to make a PFD offer.

I had a collection account for 69.00 with Enhanced Recovery ( Sprint). They would not remove after pay. I call Sprint and dealt with the Acct services Dept. They were real cool. I explained the situation, they made it so I would pay the 69 to them, give me a service credit of 70, and had the CA remove it from the CR. You might want to try that

I will call Sprint and find out if they own the debt or the CA. 

 

Not sure if this is what you are asking for as far as DOFD.  It's the only information on the CR so I think it is.  The DOLA (Date of Last Activity) was JAN 2008,

 

Also, I am pretty sure the SOL in AZ is 6 years for a cell phone company. 

 

So the SOL has not expired. They could sue but would they for $361. I kind of doubt it since I am offering to pay in full.  They may decline the PFD request, but they may not..

 

So is that the info you were asking for?

 

Thanks for clairifying what a recall is.  Was confussed about that.

I'm not sure where you got your report but reports from third party sites often don't have the most complete information. If you pull your free reports from annualcreditreport.com it should have the name of the CA.

I had the same problem with e r solution wth sprint too.  i sent them a dv letter and they sent me a copy of my last phone bill.  but they didn't validate it, they just verified it.  i guess since they verified it but not validated it, i should do a pfd.  not sure what to do now.  any ideas?  should i call sprint and try to work it out with them or do a pfd with the ca?

Whooah!

How can you have a collection with no knowledge of the name of the debt collector?

That is why FDCPA 809(a) exists.  They have to have provided you a formal collection notice within5 days of posting to your CR, which includes advising  you of how to request validation of the debt.  Contact information is part of this requirement.
