I am reposting my issue in case it got lost or over looked in the other thread.
I had a tax lein (so to speak) about 2 years ago. Before income execution started I paid it and I had a leter saying that it has been satisfied.
They just added it as a judgment on my credit report within the last month or so. I would like to have it removed. With one CRA it is reported as released and the other 2 just read filed.
I understand that it is supposed to stay there for 7 years but I would like to have them all removed. Would a GW to the state help me? I have the addresses to the county clerk (from my credit report) I was just going to write them a nice sappy letter asking to find it in their hearts to remove.
Anyone have a sample I could draw from or had a similar situation?
Yes. you need to GW the party that reported it to the CRA. I was not the court. Courts dont report to CRAs.
Sample GW letters are usually of little use, since reasons for a GW request are tied to your individual case.
Just some suggestions. Point out a long prior history of timely payment, the fact that you promptly safisfied the lien when ordered, and have had no subsquent defaults. You can put a lot of sappy "the dawg died, the roof is a'leakin, and my wife left me" reasons in your letter, but I would concentrate on financial stabilty, and that this was a one-time thing that wont occur again.
I have to disagree here about a GW letter to the company reporting. They don't care, this is what they get paid to do. The reporting company's business is to scan public records, gather information, and then sell that to the CRA. To my knowledge, no one has ever been able to find out who exactly is reporting their information to the CRA, as it is public information being reported. I'm sure if you spent enough time and got enough heat on the CRA, you might be able to find out. 99% of the time when you ask the CRA, they tell you the courts reported it, which is true and untrue. The courts reported it is public information, but the courts don't report directly to the CRA.
You need the lein cancelled, vacated, etc for it to be removed. This will take place with the filing party and/or courts.
