Ok, so this is a pretty odd situation. I was sued (thats not the odd part) over a credit card I had when I was 19 from providian. Everything was by the books... SOL was not up, and the debt is a legit debt, that I should have paid ten years ago. However, I was never served.. Found this out after talking to the cook county (illinois) sherriff who said they tried to serve me, but were unsuccessful and if i was served it was not by them. However the court case docket shows I was personally served. Sherriff says odds are that the law firm suing me hired a private company to serve me, and in which case if they say i recieved a personal summons, itll be pretty much next to impossible to prove otherwise. Now I know I was never served, and the law firm suing was also representing another credit card company that sued me... exact same scenario... I called them, talked to them and said I wanted to right the wrong and pay in full, and they worked a deal for me to pay the balance in full and the judgement would be taken off my record.
The odd part is the first judgement I am talking about doesnt show up on my credit report. Its been entered for over a year, and nothing. They tried to garnish my wages (which is how i found out about the judgements) but since I am a server, they were unsuccessful as theres no paycheck to garnish.
My theory is this... Its not showing up because instead of being sued as Charles, I was sued as Chuk. The other suit was against Charles. The credit card that I had, I had entered my name as Chuk as how I wanted it to appear on the credit card, and thats who they are suing.
Is it possible that this is why the judgement is not showing up on my credit report? SSN is mine, so it should show up still, but its not on there.
Also, what will happen if I continue to not pay this judgement?
