My fiancees WONDERFUL (please note the sarcasm) parents got into the habit of opening credit in his name when he was young. Him and his father have the same name so I guess that made it kind of easy(I bet they planned it before he was born but thats another story for another time). A few years ago they purchased a house in his name that they have since sold.When we were checking his credit report we found a few suprises. Turns out that there are two state tax liens one from 12/12/05 that court records show as being vacated and one from 3/1/06 that still shows as open and active. My questions are:
- When you sell a house aren't all tax liens supposed to be cleared up?
- How can we go about getting this cleared off of his CR and passed off to his parents?
ALSO, there is a GEMB/Walmart card that is showing on his report. Balance is 658/680 and it was opened in 1988...he was born in 1981 (you do the math). How can we get this off his report without filing identity theft charges against his parents?

Vacated liens and judgments should be removed.
As for the other tax lien.....is this related to the house in his name or for some other taxes?
On the Walmart card....is it open and in good standing? Interested in a Walmart card? If so, I would call up GEMB and report card lost, switch the address, get a new card and have a Walmart card.
Of course, you'd get the balance with it.
I would also put a security freeze on his reports or a FA.

I can't find any info on the other tax lien. All the courts show is that its an open state tax lien, nothing else. i also can't find anything on the comptrollers website. I set up an account on the website and they don't show anything outstanding so I don't even know where to go to find out what the heck its for. I'm almost 100% sure that even if its not for the house his parents have something to do with it or either his dad got the notice instead of him and didn't care to mention it.
In regards to the walmart card it says its open an "pays as agrees" but there is nothing being reported each month. All there is are a bunch of ND's for equifax and the other 2 are completely blank. Do you think it is worth taking on $658 worth of debt if its not being reported?

Does the reports show a docket number or case number? Have you actually went to the courts or called them or the comptroller's office?

What is the last reported/updated date? Where are you getting your reports from? Considering the age of the account, removing it will likely drop his scores, as I highly doubt he has any accounts this old or older that would be remaining.
If you aren't getting the reports directly from the CRA, I would do that. They have much more information.
Also, if you are eligible, then pull the free annual reports as they come from the CRA directly, just don't buy the scores or add-ons they offer.

The reports do show a case number and I looked it up on the district courts case search website and it simply said that it was open and active. Not what it was for. I sent the comptroller office an email. Neither I nor my fiancee can find the time to call them during their business hours. They haven't responded to my email yet.

The last time it reported was Jan09. I got these reports from credit check total. i tried getting them directly from the CRA but I guess because his file is so thin Equifax and experian need him to fill out this form and mail it in along with a copy of his social and DL. We also weren't able to answer some of the validation questions for Transunion because we honestly didn't know because they aren't exactly his debts.
