Third Party Collection Agency

 

I have a $100.00 collection from WOW Cable from 9/2004.  Credit Management LP has it now and they informed me if I pay it they don't have to delete becasue they did not purchase the debt from WOW.  They will not delete and mark it as Paid. 

 

They are not the OC but, they said because they did not pay for the debt they will only mark it paid. 

 

Is this true?

What is your SOL?   If you are past SOL contact the OC, in writing. Ask if they will accept full payment & pull the assignment from the CA.  If they accept then PIF.

 

If this is in Il. then your SOL is 5 years from DOFD. Remember that it goes to the last day of the month.

Not sure of the SOL, I live in Illinois. I had the cable turned off because I moved.  I never heard of the bill untill about three years ago when it appeared on my credit.  It left for a while now it has reappeared.

 

Credit Report says: Date Opened 7/2004   Reported Since 9/2004  Date of Status 9/2004.  I s DOFD 7/2004?

 

Should I send the letter in July or September?

The DOFD would be the first month that you didn't pay. This date is reported by the OC.

 

The date reported by the CA as *opened* is the date that they, the CA was assigned or bought the account. Your DOFD will be well before that date.

 

Your SOL is 5 years from DOFD.    DOFD = first default date.

 

Call the cable co. and ask when you last paid them.  If you cancelled when you moved then you should have an idea when you last paid. Was it before 2004?

Just got off the phone with WOW and they have no record of the account. I gave them dates, address and my name she looked all thru the system and could not come up with anything.

 

What now?

Do not call the CA again   Mail them a DV  CMRRR  If the OC has no record of this account then  It is possible that the debt was never yours!

hi---I live in Illinois.  I read on the SOL is 5 years.

 

Is this credit card debt?

 

After 5 years do they take this off your credit report or do you have to write them about SOL?

SoL only pertains to how much time a creditor/CA has in which to sue you in a court of law. While the time they can sue you is limited as per state law, the debt is collectible forever. SoL doesn't absolve you of the debt, just means the creditor can't use the legal system to collect it (the understanding being that if they wanted the money so durn badly, they should have sued you earlier).

CRTP is what decides how long an item can remain on your credit reports.

CRTP for credit card accounts, as per the FCRA, is 7 years for baddies, 10 years for goodies.

BTW, while SoL is the permissible defense you'd use if you were sued for the debt, you would have to appear to *use* that defense. Just FYI.
