Voicemails From a Collector

I have recevied multiple vm recordings ( and a recording when I answer ) from a firm called CJB / Legal Outsource.    I'm wondering if the messages they are leaving can be considered ' deceptive '.   The gist is:  " My names is James ( mubmles last name ) calling about a fax order for delivery at the address on record.   Please return my call as soon as possible for proper delivery of these documents".    

 

I do believe they have a legit account based on initial communication ( phone call where i answered and spoke to a rep and an emailed dunning letter that did not include the comment " notify us in 30 days... "  ) but I'm suspect dealing with what appears to be a shaddy company.

 

Are there any violations based on the above ?

 

This is for a charged-off payday loan and neither the original creditor nor debt buyer is reporting.

Did you ever give concent for the collector to call your cell phone?  This appears to heading toward possible FDCA and or TCPA violations.

The initial phone call was to my cell.   On the first phone call I said I never received a letter, etc.   They said they sent.   I said can you resend to my email but never got.   Received another call a few days later.   Said I never got a letter they were going to email and they sent over without the " please notify us...etc.. ".   The letter itself was odd in that they said they purchased all rights to the account but then says it will satisfy my deliquent account with the OC.   In a follow-up email to me they said they were an " authorized agent for the OC "

 

As far as permission to call my cell, if it's the only number on record with a creditor then isnt that giving permission per se ?

I'm wondering if they bought their mailing list and they are making it all up. Do they have accurate information of who, amount, account number, etc? Are they reporting on your credit report?

It's my account I'm just suspect of the process and handing over personal inforamtion and payment.    No they are not reporting it.

Have you contacted the OC to see if they still own the debt and who they have collecting on their behalf?  If you have the funds, you could always attempt to pay the OC.

I do believe it was sold.   That said, Im wondering if these attempted collection acitivites are in violation of anything ?    Can a decpetevie ( 2x per week ) voicemail be allowed.

Google the phone number.

 

I am getting them too but I have no debt owed not a legit one anyway.  Google tells me it's a scam.  Here is the text of my voicemail:

 

"I received a fax order regarding a complaint that was filed against you I have been retained to serve you with documents to appear at either your residence or your place of employment if you have any questions or concerns about this complaint or wish to rectify the matter you can hit any key on your phone to connect to our office directly or call us at the following number. 509-620-9010 When calling please reference file number? 3699 Three Seven you have officially been notified."

 

Google Voice and Hiya identify both the number they are calling from and the number they list to call as a scam debt collector.  Google the text "I received a fax order regarding a complaint... and it will return as scam.

 

I doubt they are legit and from what I have read they absolutely must send you something in writing in the MAIL not just eMail.  They claim they sent me both nothing showed.  I know mine is not legit but I called them back to let them have it.

 

I have been getting calls like this easily for 10 years.  They are dirty and research you to find out your relatives.  My brothers ex-wife even got a call a few months back looking for me because "I was about to be served..."  Still waiting to be served after 10 years.

 

Regardless I had a CH7 dischared 6/2016 so I I know there is no way there is legit debt.  I do believe they got my info from a payday loan from many years ago.  Payday loans are not enforcible in NJ and it's been probably a decade since I was desperate enough to use one.

 

I don't want to steer you wrong but it sounds just like the ones I got from 316-227-1858/509-620-9010
