What Recourse Do I Have?

What recourse do I have if I contacted the OC for a pfd and the agreement was that if I paid them directly they would recall the debt and the collection would be removed from my credit report. But, after the debt was paid I called when the item was updated by the CA as paid to ask about the deletion. The man I spoke with said to wait 7-10 days for the deletion. I waited and then called back only to hear that the item is not going to be deleted. I escalated to a manager but the best they could do was forward my information to their corporate escalation dept who should contact me in 24-48 hours. Any idea if there is anything I can do if they don't honor the agreement?

Have them pull the recordings of the calls. CSRs will often use "weasel words" or ambiguous statements that can be misinterpreted, in order to lead you to believe one thing while actually promising another.

Re: What Recourse Do I Have?

A creditor has no authority to promise the deletion of credit reporting that they did not make.

You could persue civil action against the credtior for misrepresentation, but the outcome will still not require the debt collector to delete.

Best bet is to ask the creditor to contact their former debt collector and make a request on your behalf that they delete their reported collection.

You could additionally file a complaint with your local BBB over their poor business practice.

Re: What Recourse Do I Have?

Thank you both for your help, I will ask to see if they will make the request on my behalf before doing the BBB complaint.
