What constitutes proof?

What constitutesproof?

Im gettingpretty frustrated..   I have two accountsshowing late that were  in deferment.  I have mailed in the deferment paperwork toall 3 bureaus with mixed results.  BothEQ and TU have removed  only1 of theaccounts, the opposites of each other. .. Experian wont accept the written proof of the deferments at all,  though they are copies of the originaldocuments from the creditors that fully verify the deferments..

If they wonttake black and white proof and fix an error, what can you do?

Re: What constitutes proof?

Contact the lender (in writing) and ask them to correct the reporting.

Re: What constitutes proof?

What you are seeing is the impact of the stupid E-Oscar automated dispute resolution procedure used by the CRAs.  Contrary to the requuirments of FCRA 611(a)(2)(A) that the CRA forward "all relevant information regarding the dispute that is received by the agency from the consumer," they dont do that.  They reduce your dispute to a handful of dispute codes, and dont forward all information to the creditor.  So the result is almost always verification.

I suggest you read the testimony on this issue submiitted to congress back in 1997 by the National

Assoc. of Consumer Advocates.

It can be accessed by googling on the name of Leonard A. Bennet, and viewing the testimony titled:

Written Testimony Before The

HOUSE COMMITTEE ON FINANCIAL SERVICES

Regarding

"Fair Credit Reporting Act: How it Functions for Consumers and the Economy"

June 19, 2007

(Jump to pp. 18+ of that testimony for discussion of this issue)

Hmm.. Anything you can do to force them to not rely on E-Oscar?
