capital one charge off from 2008 reports every month with additional late fees. TU removal date is 6/2015. if i request early exclusion and it does get removed, can CapOne just report again next month and create the TL from scratch again?

Nope, the CRA "excludes" it from your report due to age.

if the removal is not initiated by the creditor it can resurface.
The creditor has nothing to do with credit report exclusion of the charge-off other than reporting the DOFD.
After obtaining the DOFD, the CRA monitors the DOFD and must exclude no later than 7 years plus 180 days after the reported DOFD.
It can not be reinserted in your credit report after expiration of its exclusion period.
How do you request an early exclusion? I have 3 medical collections all set to fall off in september 2015. They're all outside statute of limitation in my state.

Either by phone or writing a letter to the CRAs. You should start trying with TU 6 months prior and 3 months out with the others. States SOL has nothing to do with how long a derog can stay on file, thats governed by the FCRA.
they age at 7 years in sept but what if experian states they fall off in june? can i do it from 6 months before the report says?
