sprint collections appearing twice on cr.......

i have an old acct from sprint that was sent to collections (i had 2 phone lines and was charged 2 disconnection fees). the whole bill is about $600.  they turned around and sold it to anoher collection agency.  now it is on my cr twice.  i was thinking about contacting sprint and asking them to take it back and just letting me pay them and maybe offer them a settlement offer.  does this souhd like a good idea or what should i do?

 

i just do not like the fact that is appearing twice from 2 different companies.

i am open to any help that anyone can give me because i am trying to get this taken care of.

Who is reporting? Two CAs? One CA and one OC?

yes two ca.  the new one was just placed on my cr last month.  who do i pay? i just want to try to do a pfd and get it removed.

From what you have posted, it is kinda hard to tell who owns what, and on whose behalf the collections are being conducted.

Here, for example, are a couple of  possible scenarios:

1.  The OC still owns the debt, and merely contracted with CA1 to collect on their behalf.  CA1 then reported to your CR.   Then the OC ditched CA1

      and placed collection with CA2.  Once CA2 reports, CA1 should have deleted. You could then offer to pay either the OC or CA2.

      Both the OC and CA2 reporting would thus be in your CR

2.  The OC sold the debt to CA1, and CA1 reported their collection to your CR.  In that event, the OC reporting would still remain, but you

      would no longer be able to pay the OC.  They would be out of the picture.  CA1 would report.  If CA1 then sells the debt to CA2, then you could only pay

      CA2.  ONly the OC and CA2 reporting would then remain in your CR

I'd send both a DV letter. One of the two will likely delete right away. The other, if they verify, would be the one you'd want to send the PFD to. Now they don't have to respond to the DVs since it is likely past the 30 days since the dunning, but most do respond and I bet one will go away with those DVs.

so when the ca2 was added, ca1 should have been deleted?  they are still showing but nothing from oc.  so i should pfd cr2 but how can i get ca1 deleted because they no longer have the acct?

With the new company, i never received anything at all in the mail..nothing.  so can i stilll dv first or pdf first?

Yes, you can DV them once you become aware of their collectiion activities.

If the new CA posted to your CR, then they were requried under FDCPa 809(a) to have sent you formal collectiion (dunning) notice within 5-days of that posting.

If they did not, then they would be in violation of FDCPA 809(a).

But you dont have to have received a dunning notice as a pre-condition for a request for debt validation under FDCPA 809(b).  Their lack of a dunning notice, in fact,  works to their detriment, for they cant assert failure of you to DV within 30-days of a collection notice they never sent.
