To Whom It May Concern:
This letter is response to correspondence that I received with regards to a dispute that I have filed on my Equifax credit report.
Your correspondence states:
Tradeline Information
Northern IL Universi XXXXXXXX1998 07/01/1998
ADVERSE ACCOUNTS THAT HAVE BEEN PAID IN FULL WILL AUTOMATICALLY BE DELETED SEVEN YEARS FROM THE DATE OF LAST ACTIVITY.
Date of First Delinquency/Date of Last Activity was in 1998. I enrolled as a student in 1998 at NIU, and withdrew from the school late. The amount that I was to pay was in 1998. The account was not an installment loan. The lates reported are inaccurate as well. I did pay the account in full. This account should have aged off as it is10 years old. Both Transunion and Experian have aged this account off.
Per FCRA 605(a), Requirements relating to information contained in consumer reports, this should be removed from my credit report immediately!the following information is excluded from consumer reports
FCRA 605 (a)(4):
(4) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years are in violation.
FCRA 605, Running of Reporting Period:
FCRA 605 (c) (1) states:
(1) In general. The 7-year period referred to in paragraphs (4) and (6) 3 of subsection (a) shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action. In order for your company to be in compliance with FCRA, please remove this account from my credit reports and send me an updated copy of my credit report.
Please note that under FCRA 616, you can be held liable for willful noncompliance.Sincerely,XXXXXX
Okay, Now I am at a loss what to do here...threaten them with something? Anyway to beef this up?
Thanks!
