writing CRA, need help!

CSC Credit Services-Disputes

To Whom It May Concern:

This letter is response to correspondence that I received with regards to a dispute that I have filed on my Equifax credit report.

Your correspondence states:

Tradeline Information
Northern IL Universi XXXXXXXX1998 07/01/1998
ADVERSE ACCOUNTS THAT HAVE BEEN PAID IN FULL WILL AUTOMATICALLY BE DELETED SEVEN YEARS FROM THE DATE OF LAST ACTIVITY.

Date of First Delinquency/Date of Last Activity was in 1998. I enrolled as a student in 1998 at NIU, and withdrew from the school late. The amount that I was to pay was in 1998. The account was not an installment loan. The lates reported are inaccurate as well. I did pay the account in full. This account should have aged off as it is10 years old. Both Transunion and Experian have aged this account off.

Per FCRA 605, Requirements relating to information contained in consumer reports, this should be removed from my credit report immediately!

FCRA 605 (a)(4):

(4) Accounts placed for collection or charged to profit and loss which antedate the report by more than seven years are in violation.

FCRA 605, Running of Reporting Period:

FCRA 605 (c) (1) states:

(1) In general. The 7-year period referred to in paragraphs (4) and (6) 3 of subsection (a) shall begin, with respect to any delinquent account that is placed for collection (internally or by referral to a third party, whichever is earlier), charged to profit and loss, or subjected to any similar action, upon the expiration of the 180-day period beginning on the date of the commencement of the delinquency which immediately preceded the collection activity, charge to profit and loss, or similar action.

Okay, Now I am at a loss what to do here...threaten them with something? Anyway to beef this up?

Thanks!

Re: writing CRA, need help!

Pizza Puffs, anyone?  Tom and Jerry's after hours?  Oh, I'm having a really strange flashback.  NIU 1981-83.  Sitting on the gargoyles at Altgeld on a very cold Autumn evening, outfoxing the Husky Rangers.

My paid loans that have been paid in full for almost 20 years are still reporting.  Shhhh.....

Re: writing CRA, need help!

Not much help heer with the terms of your letter, but with language I can be.

In the first part of your letter it reads, "with regards to," this is a common mistake, it should actual read "with regard to."

For instance, if you are saying, "I am writing you in regards to (see how it sounds odd)." "You should actually writ, I am writing you in regard to."

Regards is a salutation (i.e.: Best regards).

I know, not much help, but the more professional and well written your letter is the more it will come across as you are someone who knows what they are doing and one not to mess with. Perception is 50% of the game at times.

I may not be perfect every time and don't like putting so much editing into things I write, but sometimes a good edit and scrub can make the difference between making your point and others getting lost in the words.

Not a problem, any time.

FYI-I took sidewinder's edits and just added more to that so the letter I posted includes edits from each of us.
