I have a medical collection in my one of my accounts. I was hoping capitalize on the 6 year statute of limitations my state has (MA) to try to get rid of this. However, I'm a bit confused as to when the time period begins. My account shows the following:
Date assigned : Feb 01, 2004
Date reported : Feb 01, 2009
Date last active : May 01, 2003
-Thank you!
Hi, sorry for the delayed repsonce, I've been out of the country for a few weeks.
I realize that the SOL doesn't have anything to do with reporting. The reason I asked that, was because if I use the HIPAA process, I didn't want it to come to their attention and try to go after me. If I wait until the SOL clears, then even if it comes to their attention, there's nothing they can do about it legally. I know that the SOL in Mass is 6 years, but I wasn't sure when this time started.
From what you're saying the SOL starts on the date of the actual incident. I can't remember the actual date, I believe it was January 2003. I'll check my EQ report, since that's the only place this collection appears, my other two reports are clean.
-Thanks!
It's from a medical office that does MRIs and CAT scans, and that's all they do there. It's not a hospital or doctor.
-Thanks
SOL for your type of med debt is four years in your state. Obviously, you're out from under the SOL. Here are the first few steps in the HIPAA letter process.
Step #1: Opt Out of two things: Your Credit Reports and All Creditors. The first one ensures that the CRAs will not sell your personal data to anyone else (haha…no more data mining). The second one will prevent JDBs (and CAs) from buying and selling bogus collections.
Use this link to opt-out of your credit reports
OPT-OUT CREDIT REPORTS (or call 1.888.567.8688)
Use this link to opt-out from all of your CURRENT creditors that you're in GOOD standing with. Do not attempt to opt-out with any CAs or current creditors that you're in BAD standing with (i.e. charge-offs, or currently late).
Step #2: Also, be sure to update your personal information with the CRA's before attempting to reestablish your credit.
Step #3: Send the pre-HIPAA dispute letter to the CRA ('s) CM (no RR, this is the only letter in the HIPAA process where you will not send it CMRRR) and wait up to 35 days for the results of the their investigation(s). Be sure to handwrite this letter (and the envelop too) using personalized stationary and teal blue ink. If your med collection is deleted, you're finished.
