New collection-can they do this???

Hey everyone,

I got an alert today that said my credit score dropped 79 points.  I was shocked because there is nothing that would make my credit drop so much.  I got online and saw that there was a new collection listed on my account.  Here's the deal though-This account is from an emergency room visit from a little more than a year ago.  (1/24/08 to be exact.)  This was an injury I had at work.  It's covered by worker's compensation.  Every bill I got, I sent to my worker's comp insurance.  Six months after my accident, I got a bill from the emergency room for $102.  I sent it in but worker's comp was not paying it.  They were taking their time I guess.  Even though I was getting pre-collection notices, I was told that it is illegal to send bills to collection if it is under worker's comp.  Well, they sent it to collections and now my fico score is minus 79 points.  Oh, not only that, in december, the emergency room figured that they weren't going to get anything from my worker's comp insurance so they billed my regular insurance and my regular insurance paid it.  So why on earth would they send it to collection when it's been paid?  How can I fight this?  Also, does anyone know if it's true that worker's comp claims cannot be sent to a collection agency?  Thanks.

Why won't your worker's comp insurance pay for this? Have you called your adjuster? Do you know if this med collection is on all three of your reports?

I called my adjuster today and she said workers comp paid the $102 last May.  She also told me that she called the hospital and told them it was workers comp and not to refer it to collections.  I called the hospital billing too and they said they sent it to collections in May.  Why would the collections just show up on myfico now?  Oh and why was I still getting pre-collection notices January of this year if it was already in collections?  Something's not right here...

 

I haven't checked all three reports yet.  I'll do that tomorrow.
