Is it easy to have removed from my credit reports. If so should i have them reinvestigate it once it is paid in full?
Some say what is the purpose of the collection agency to report it or verify it , if all obligations have been settlement?
I will be anxious to see the 'experienced' response to this question as I have wondered the same thing.
I also have several medical accounts, which I paid in full to the CA and wonder if the process of 'verifying' is necessary or if I can just write one HIPAA letter asking that it be deleted from my CR as they no longer have a 'business' case related to the debt at the CA.
Thanks
What is a HIPAA letter?
Quick question fused. I paid and OC this morning and received the receipt and a letter on company letterhead stating " We have notified CA to delte all information they may have reported to any credit reporting agency under your name and/or social security number regarding this account".
Is there a special letter to send to the CRA's with this for them to delete? The problem is we have disputed since they are only reporting on DH's CR and not mine and the bill is mine. Well, we sent the CRA's a bill showing that it was in my name only from the OC and they would not accept that since it wasn't from the CA.
Thanks!
HappyDays, yes, we have opted out. We did not send a HIPAA letter. We disputed and of course it came back verified. See the OC had the debt in my name only, but the CA had it in DH's name and only reported it to his CR and not mine. It was a hospital charge that ins did not pay. It was a small amount (131.00). This is the newest collection (12/08) on DH's account and we are trying to get a mortgage, so we desperately needed this to go away. We did consult with an attorney and he did say that we have grounds to sue the CA since they were advised by the OC to quit reporting on DH's CR, but yesterday we decided to just let it go and pfd. It would have cost much more (for the attorney) than the amount to get it resolved than just giving in and paying it to have it removed. Honestly, we were going to pay it after they quit reporting on DH's CR since we did owe the money, but we were trying to play hardball with the CA, I guess you could say. DH and I discussed it last night and if we were to persue the lawsuit, could we have won money? Maybe and maybe not since we do live in a common law state. The attorney said regardless of Tx being a common law state, they have no right to place my medical on his CR. Which, I have seen on here that some states can do that. DH did not sign the paperwork at the hospital as he was at work. However, I did write his name under "responsible party". So, we decided to skip the lawyer and pfd.
I went straight to the OC's supervisor/coordinator and paid. She immediately (while I was on the phone with her) called the CA to tell them to contact the CRA's to quit reporting immediately. She faxed me the receipt showing that the debt was paid to the OC along with a letter for our documentation (worded in the previous post) to send to the CRA's. She did speak directly with her contact at the CA, which was a supervisor. They did advise that they would handle this immediately and not make us "wait the normal 90 days before they quit reporting".
Sorry to be so long winded, just wanted to give you all of the details on this. I am wanting to send the CRA's copies of the OC's letter, proof of payment, and a letter so I can speed to process up. We are wanting a 23 point gain "somewhere" and I think that this delete will help gain some of those points. This is the most recent derog on his report. Most of the others will fall off before next year, so they are old.
Thanks Happydays!
Not long winded!! you told me what I needed to know.
File a dispute with all CRAs reporting. They should delete as the CA can not legally verify! You should not need to send the copy of the letter from the CA.
The CA must be notified within 5 days of the CRA receiving the dispute.
Thanks so much for your quick reply HappyDays! Many kudos to you!
The CA must be notified within 5 days of the CRA receiving the dispute.
I was not aware of that.
Thanks!!!
