I am a newbie and been reading for about one/two weeks now.
I completed step one for opting out. I have a paid collection (medical) that has been in my account since 2006. Do I just use the Per Hippa letter or do I write a letter to the HC providers. I also have a second medical collection which I still owe 1300 on. What to do. Would it be wise to pay it off.
My husband also have medial collections from 2005- one 9K and one 7K and one $500 ( ambulance bill). I called the HC providers and asked that they delete it if paid or settled. They refuse. I also call the CA to see if I could settle, they said they will but will not remove the collection until 7 years. One of them said, the Hippa law is only fo the CA's company to not share information. Is that correct. I am tried of these people and need some help as I have been trying on my own for about one year now to get my husbands credit score to a 620 so we can buy home in 3 months if possible. His credit score was a 413 due to collections, some were dropped off after disrupting them and I got it up to a 552 with the help of God and a whole lot of time and effort. Now it went down to 471 because two student loans that he is paying on and went to collections.
Okay Someone Please HELP.
credit score now 629 shooting for 700.
The HIPAA law is protection that your medical info. will not be shared. HIPAA covers hospital, Dr. Dentist etc.
The CA doesn't come under HIPAA but all medical providers do.
You should not have any contact with the CA about medical collections.
The HIPAA process must be followed from the beginning to the end with no skipping steps. This way you have a paper trail.
In order to use HIPAA the collection must be reported. Then it must be paid or you will be PIFing using the OC letter.
If you can not afford to PIF I would make payments to the OC only until it is PIF.
For you & the paid 2006 medical
Opt out then handwrite HIPAA dispute letter to all CRAs reporting. Sit back and wait for all 3 to be completed.
If the are deleted then you are done. If verified then follow the correct scenario. If you are unsure please ask so that we can help.
For the unpaid one follow the same step (HIPAA dispute letter). You will need to be able PIF after the dispute.
Your hubby..................only paid medical collection must be deleted. He has some biggies.
Medical collections are different from regular collections when it comes to CRTP. Regular collections drop from your CR approx. 7 years from DOFD. Medical drops 7 years from Date Of Services.
Just because they drop from the CR does not mean that you do not still owe them. Some states have no SOL on hospital debt and can file suit at any time.
wow. Thank so much for replying. Would it be better to pay the CA little by little for my husband or pay the Medical providers directly. And if we are making payments to th CA or the Medical providers each month will this raise his score. Also, is there a letter where I can ask the CA to take the collection off the CRA's if I start paying monthly. Is there any hope for my husband. Because of his credit, we have not been able to get a house. I would try to qualify on my own, but I own a house already for five years ( rented) and make about 40k yearly. My income may not be enough for me to qualify on my own ( a decent home).
any suggestions?
