I don't know what shocks me more - that Apple let this through, or that it was ever created in the first place.

Neither defending or criticizing but the fact remains that everyone is entitled to say, believe, do, and publish anything that doesn't violate a law under the freedom of speech. This means that the programmer is entitled to create whatever he wants and its the people who can choose to download, install and use it or not. Its like porn, you may not like it, but if joe blow wants to buy it, that's his choice and all we can do is avoid it. Listening to the radio station, you can choose to not listen to it if you don't like it, argument used for Stern. The fact is that as long as you have a choice to avoid it if you object, then there is nothing wrong or illegal about it, even if in bad taste. This was a decision that was supported in protecting porn under the first amendment, no matter how distasteful or unfortunate of a media it might be. However, child porn is not covered because it violates the law. This application, however in poor taste or insensitive it might have been, was legally protected in its right to be created and provided to anyone who wants to download it. No one was forced to get it, it was individual choice. It is a shame that a company like Apple will cave to public pressure to remove it, but as a father myself I find it distasteful and a privately held corporation Apple has a right to cave and remove it, but as a man of principle and ideals, I believe this is wrong and violates their right under the law. Anyway, just my two cents.
Very well put there Guardian........
