Creative Sallie Mae post-rehab strategies??

So, I continue to bang my head against the wall with my fully rehabilitated loans that went into default when they were with Sallie Mae from 2011-2013.

 

By way of history, I had two sets of loans that went into default. I fully rehabilitated all the loans and they have been serviced over the past year with Navient and Great Lakes with perfect payment history. All prior loan holders, including the USDOE and Citibank completely removed their TLs . . . the exception is Sallie Mae. Sallie Mae is holding to the strict interpretation of CFR 682.405 which reads in part:

 

"The prior holder of the loan must, within 30 days of receiving the notification from the guaranty agency, request that any consumer reporting agency to which the default claim payment or other equivalent record was reported remove such record from the borrower's credit history."

 

That means that any notation of "default" is removed, but all record of prior late payments that preceded the default remain. It seems not to be in the spirit of rehabilitating student loans to good standing, but that's the current law. 

 

I've exhausted all avenues of disputing the TLs with Sallie Mae and the CRAs. I've even sent a request for help to the Ombudsman's Office, to no avail. Does anyone have an creating strategies to getting the Sallie Mae TLs removed?

My most recent letter to the CEO of Sallie Mae was replied to from the Office of the Customer Advocate in which I was told, "We have determined that you do not have loans serviced by Sallie Mae Bank."  Unbelievable!

 

My letter was VERY clear that I was writing regarding loans serviced between 2011 - 2013. I will reply with copies of my credit reports with their TL, and an old Sallie Mae statement.

 

Onward . . .

PROGRESS AT LAST! I received a call today from the Customer Advocate office of Sallie Mae (and the rep was very pleasant and helpful). It was explained to me that when Sallie Mae created Navient to handle the DOE side of the student loan business, all account histories from old Sallie Mae serviced loans transferred to Navient. Therefore, Sallie Mae has no control over the old tradelines. The only difference is if you have private loans, in which case Sallie Mae still controls those. 

 

I was given the phone number for the Customer Advocate at Navient and explained the history of the situation. To my pleasant surprise, the rep advised me that they were familiar with the issue pertaining to old Sallie Mae tradelines, and she escalated my call to a person within the office who specifically handles credit bureau reporting. I was told my credit reports would be pulled and I can expect a call within 24-48 hours.

good luck. Navient is pretty good with getting back and working with people with negatives as long as its not recent.

Could you share that number for Navient. I am currently going through the same situation. CR still showing late payments pre rehab from Sallie Mae. Now loans are with Navient and in good standing.  Just want to get rid of those lates! Thanks!

UPDATE - not exactly the result I wanted, but at least the Office of the Customer Advocate addressed my concerns and clearly communicated their position. I received a letter dated 6/29/16 which states that Navient/Sallie Mae has confirmed that all my loans were successfully rehabilitated, but they will not remove the delinquency history between the 90th and 270th day on the prior history. They will however, remove any notation that the loans were assigned to the Government.

 

I'm going to wait a month, pull my reports, and confirm that the status changes have occurred.
