I'm attempting to avoid panic

Hello friends,

I have had ">120 days late" US dept of ED lates on my CR from 2013. I called my loan servicer today and spoke to a young man (a hero, really) and he states that all my loans are in good standing and have never had negative history. He said he's going to have a letter drafted which states that, and I should take it to the Credit Bureaus to have my credit corrected. Is this really how easy it is? Is there any risk?

I'm trying not to panic or get overly optimistic, since I've struggled with my credit for a while and this could be a dream come true.

In theory, that should be it. When you dispute the accuracy of the payment history, you should be able to submit evidence to back up the dispute.

I'm sure there are folks here that can provide a lot more intricate detail, though.

Re: I'm attempting to avoid panic

I agree with jl4, it would work. However I've rarely known for disputes with my loan servicer to go smoothly. First if all, I assume the loans are federal. My understanding is loan servicers report the information in your account to the credit bureaus. It's not the credit bureaus that are deciding that your account is late. I think it's your loan servicer has an error if there are not lates. Getting their statement in writing is a good idea. My suggestion is to also speak with your loan servicer but get past that first person. I'm off the option they purposely mislead you, lie to you, Don't know how to do what you're asking it all of the above because most calls I make only end up being resolved by the account specialists. They know their stuff!
Second step of you feel they are making you run around in circles still, I would personally file a complain with the CFPB. At some point the payments I made were "disappearing" after the them out and they kept dragging their feet to find out why. Time was running out towards a default that was not my fault. I finally just decided on a CFPB complaint. The company got back to be right away, and fixed the problem the same day.
Did you check your loan servicers website? How does it show up there? What about the National Student Loan Database (NSLDS)? If it's late in those two places, it's definitely the servicer.
Another resource is the Ombudsman. They take a longer time to respond in my experience though.
Good luck!

Re: I'm attempting to avoid panic

Thank you for the clear responses! It is a federal loan. I haven’t received any run-around at all, actually. I called myfedloan, the guy said they have no negative record and I’m in good standing, and i should expect to receive a letter in my email this week saying so. I decided to check my credit report, and i only just noticed that only two out of three of the CBs report these lates. Curious.

Re: I'm attempting to avoid panic

Is this a fresh loan or a reconsolidation? If it is fresh then something reported wrong. If it is a consolidation then did you ever have a 120 late on the previous loan? It might not have transfered to the new servicer correctly. I think I remember Fedloan being a good servicer.

They’re all original loans, I’ve never consolidated.

Re: I'm attempting to avoid panic

In that case when you get the letter attach a copy to each dispute and happily rail the credit bureau.

Re: I'm attempting to avoid panic

So now that you got the notice of default...
Did you check the NSLDS yet? You really need to do this ASAP so you can contact the servicer. If it says FedLoan Servicing, you'll need to do what I was telling you about, but if it's not you will need to sort things out with them quickly to prevent default. You don't want that on your credit reports if you can prevent it imo.
Another thing I think you need to do is go back to the studentloans gov website and print out your promissory notes for each loan and your total student aid record. This will help you keep a record of how many loans you got total. I strongly suspect one didn't have updated contact info and got lost in the shuffle (if it's not just a FLS mistake).
The sooner you do this the sooner you will also be able to have a positive payment history starting now on your credit report. Federal Student Loan lates unfortunately cannot be removed.
If it's too late and you're already in default, no worries. We can walk you through your options to get out of default & restore the loans to a servicer.

Re: I'm attempting to avoid panic

Actually, I take that back. You said the >120 day lates are from 2013. You're more than likely already in default. Check NSLDS to see which collection agency has it.
