Navient backdated forbearance

Hello all, I'm a new member here on the forum. I need help on how to approach this situation. I have a string of lates with Navient starting on April-August 2018 showing on my credit reports as 90,90, 90, 120, 120. I was granted a forbearance from Feb-Dec. 2018. When i requested a letter detailing the dates of my forbearance it shows a begin date, end date, and post date. Can i use this letter with the credit bureaus to dispute these late payments? When i asked a navient supervisor why april through august was reported negativly i was told my forbearance had been backdated. I apoligize for the format but i am new to all of this and just trying to repair my credit.  I appreciate any help!

I would think they can be removed since they're included in the forbearance period, regardless of it being backdated.

Hello,

I am trying to do the same with mine. I am interested in how to get the CB to remove the lates during the time of forebearance. I have a period of forebearance where my payments are still reported as late. I did try to dispute before and was unsuccessful. Looking for a template of what to write when sending my dispute to them for these late payments to have success. 

I tried to have them removed about a year ago with no success.

from my understanding from previous DPs, is that, no, they cannot be removed via dispute. While you are given retroactive forebearance, they need not change your CRs, as they are mostly just helping you catch up on your SL payments, not necessarily to improve your CRs. Some people have had luck, but many have not, and some have had additional lates added when disputing these SLs. They often cite the need for "accurate reporting".

 

I would search the SL threads, as I know some have had luck getting them removed, and maybe there is some info in there that can help you get them removed.

While not guaranteed - I would try to goodwill them with the servicer.   The CRA will generally just take a dispute, ask the servicer if it's correct and report from there.

If you search the rebuilding forum, there are a lot of threads with examples, and there's a mega-thread with the saturation technique.   I've had luck goodwilling with some servicers, so it's possible, and it really only takes your time and effort to do.

With Navient when they put you into forbearance regardless of it being before you slip backwards or backdated they are supposed to either report paid as agreed or no data for the affected months. Any lates should be changed over the next few months after the forbearance is applied to no data. Since this is about a 2018 issue and it is over 2 years later the correct process is to send a letter via Certified Mail to Navient at the address listed on the report asking for the correction to reporting. They will either then update after researching for 30-60 days or do nothing. If they do nothing you grab a lawyer and they will handle the issue.

 

The only catch is I believe that you must completely catch up by the end of the forbearance.
