Thanks, guys, I had never taken the time to think through the court decision. Since the key issue seems to be that the account that they're trying to collect on must have come from a customer seeking credit, that indicates to me that a CA can't do a hard on a medical collection, for instance, or the poor sap with the parking tickets or towing bills, or whatever it was. But if the collection was for an old car loan or credit card, it's fair game.

Am I reading this right?

That's the way I read it.  Keep in mind though, I'm just a software developer, so what do I know? Smiley Tongue
 
Keep in mind, too, that this decision came down in the 9th Circuit, which is always a little quirky, and AFAIK a similar decision hasn't been held by any court in another circuit (yet).

No problem, it has been instructive.

I guess I am at a 50/50 stage.

The NCOs were tradelines that were disputed and removed, so technically I guess I can write the CRAs OR NCO and ask to remove. Who knows what Pandoras box I open?

Also, NCO and Asset Acceptance were Inquiries placed AFTER the accounts were transferred to them, and to my knowledge that does not allow them to inquire.

Finally, they seem to be going off my report on 5/08 and it seems by the time I dispute and threaten litigation they'll be off.
