Experian FICO weirdness

Something weird is up with my Experian report... I had a BK CH7 discharged last year, today my Experian FICO updated and dropped 29 points, saying

 

The time since your last derogatory mark— or negative information on your credit report—is now 0 months, meaning you have at least one new derogatory mark on your report.

 

On your previous report, you had 0 accounts ever 30+ days late—now you have 1, which usually means you have a new late payment on an account that's never been late before.

 

Your percentage of accounts with no delinquencies decreased, which usually means since your last report there is at least 1 new delinquency on an account that previously didn’t have any.

 

The weirdness is that I actually have no new or any actual lates, or delinquencies or derogatory info showing beyond the accounts that show as included CH7. I looked at all my open and closed accounts, none of them say late payments anywhere, I don't even see anything that says updated today/yesterday...am I missing something?

 

I checked TU and EQ as well and neither of them show anything new or any lates at all which is correct as I was technically current when I filed for BK, any insight or advice would be much appreciated

Update --- It seems as if my student loan lender (navient) flagged your account as Chapter 7 Bankruptcy Petition on Apr 26, 2023... I guess that counts as a new derog? it appears as if i filed on April 26th! even though my case was discharged 6 months ago. Is this something that will contiune to happen, is it even legal? ahhhhhh

You may as well learn to live with it. You will have a major derogatory for 10 years.  Work on the things you can change, because this is something you can't change.

I understand it will be reported for 10 years although my student loans were not included and I didn't file an Adversary Proceeding or anything related to them so it makes even less sense to me...  I'm trying to understand how it can report: Status: Closed -- Petition for Chapter 7 Bankruptcy/Never late. --- April 2023. when I did't file anything.

 

I should expect that this will update randomly until I resume payments (next month) or the BK drops off? its a private student loan

The public record file date for a BK is on your file. That will never change. So in way the comments isnt doing any more harm that the BK is doing on its own. You could wait a month and see if it fixes itself. After a BK. All kinds of weird things happen on credit reports for a while.

I'll try not to pay attention to it too much, or any other weirdness that pops up. I guess any lenders looking in the future and the removal in 9 years would go by the original dates anyway. This is just extra odd becuase it wasnt even included, maybe once I make the payment next month it will correct

Updating this incase anyone else has similar problems/questions in the future...

 

According to Experian everytime Navient "updates" my account (So far this has only impacted Experian ) it will appear a new CH7 petition, derog, late - My score will drop 20-30 points and should correct in a week or so since its not actually new CH7... Experian suggested speaking to Navient, i'm not going to waste my time, thankfully it does seem to correct, it has twice now - It's a blow to see the drop for nothing tho.

 

Fingers crossed after I make a few payments, May/June/July or something Navient will report it correctly but I am not counting on that

Maybe this should be in the Student Loan forms now or the bankruptcy? but I don't want to start a new post.

 

The weird scoring I can live with - monthly updating of "Navient flagged your account as Chapter 7 Bankruptcy Petition" with experian and  score drop 20-30points with a rebound the same amount points in 7-10 days is SOOOOOO weird but I understand that CH7 does weird things to scores and reports. 

 

I guess the weirder or bigger? issue now is that Navient will NOT accept a payment - these are private loans -  they claim my account is part of an active bankruptcy chapter 7 petition ... its not? how could it be when my CH7 was discharged in Dec 2022! and the loans were sadly not included. I'm not sure what to do if anything with this...should I be contacting my attorney? not like i can talk to navient, they refuse to discuss 'account details'  because account is 'part of an active bankruptcy'

I would definitely speak with your attorney.  While plenty here are more knowledgeable than I am, I can assure you we're all not qualified to give legal advice on that.  That being said please do update us on the results as new data points are always a plus.
