Boscoe, did you ever get an answer to this somewhere? I have the same question. BK discharge date of Jan 2005. I have an credit card account on EQ with Status As Of = November 2008 but the date of last activity = May 2004.
Last summer, I noticed the Status As Of was updating monthly for this card while every other account in BK filing had Status As Of dates in 2004. So, I disputed. While the account was under dispute, my scores went up 10 points. Then, after the dispute was done, my scores went down 10 points. By the way, the dispute was without recourse: the credit card company said nothing was wrong, that they had the right to report a new status every month, updating the Status As Of date, even though no new information was being updated.
I have talked with the credit card company, Equifax and Fair Isaac. Everyone just gives me the runaround. I have given up trying to figure it out on my own.
Not sure this helps but I have been going around with Equifax on this very issue. From what I have come to understand is that all reporting on that account stops with the filing date of the BK. However the 7 year clock for the negative accounts could have started ticking prior to that filing date.
Example: I have 4 student loans included in my Chapter 13. All state IIB/wage earner plan. However I had lates prior to my filing in 2005. So 1 loan falls off in 2009, (date of first delinq) and the other 3 in 2010. That is long before the 2012 Bk 7 year filing date.
As to TU going by date of last activity, I believe that to be true as they do not show "date of first delinq" However my BK wiped out ALL of my late payments so it is hard to tell for sure. And TU deleted all of the accounts I disputed. Guess they would rather delete than fight.
I have found Equifax by far the most difficult to work with with IIB accounts. And any account that is reporting after your file date is in violation of the FCRA and the automatic stay.
