Just this week, I got a text message from Halstead Financial that said they were contacting me on behalf of Credit One credit card.
I claimed bankruptcy 8 years ago - 2017. It was completed in September of that year. Since then, I have been paying on my Credit One card - no late payments, no missed payments, and multiple credit increases from 2017 - 2024. Ever since the bankruptcy, I monitor my credit and get monthly reports from all 3 credit reporting companies. Randomly in May or June of last year, my credit report showed the Credit One card as well as my Kohls card as "indcluded in Bankruptcy" and both cards were closed. I contacted the credit agencies to dispute it given I've been using and paying on both cards for 8 years. Kohls removed it and it continues to show in good standing and I'm able to use the card as I have been. As soon as Credit One got an inquiry about it, they closed my account, blocked me out of it on the app and it disappeared off of my credit report. Now I'm getting contacted by a financial institution telling me I owe a debt.
So a few questions ....
I've worked really hard in that 8 years to get my credit scores up to where they are now, and to add insult to injury, I am looking at buying a house in the next year or so, so I cannot have something like this messing that up. This makes no sense to me.
I have downloaded all of my credit reports since 2017 which all show that the account(s) were in good standing and paid on time. I'll be getting all of my bank statements to show the payments as well. I'm just not sure how to handle this. Any suggestions / help would be greatly appreciated.

- How can they sue me for a debt that they deemed was included in the bankruptcy?
- Are they actually allowed to sue me when something is included in a bankruptcy?
- How can they decide 8 years after the bankruptcy that they are closing the account for being included in a bankruptcy - and then try coming after me as if I ran out on what I owed, when I was already consistently paying on the account?
- How do I make this go away? I didn't choose to stop paying on the account. They took that option away from me.

This could be complicated being that since you've been using and paying the card since the BK, they could be taking the stance that by doing so you were essentially reaffirming the debt voluntarily. They could try to come after you citing those reasons. Whether or not they could be successful is another matter. The best thing you could do is contact a BK attorney for guidance.
first question did you have a balance on it when you filed your BK? You are supposed to list all cards when filing , although I have seen some cards with zero balance survive .
if you had a balance and included why on earth would you pay it ? It's credit one this bank is very easy to obtain again after BK .
if you continued to use it after your discharge you could very well be sued possibly, but that's a little tricky if said account was included in BK and is the sane account number etc .Not sure why they didn't close it either , stupid on their part .
I'm a bit confused by your post. I assume you had the Credit One card before you filed BK. Some questions:
1. When you filed BK in 2017 was there a balance on the Credit One card?
2. Did they not close it? (You said you kept using it and paying on it).
3. Did you have the Kohls card when you filed BK in 2017 or did you get it after dishcarge? I'm not sure how Kohl's plays into the Credit One sceaniro (Kohls cards are from Capital One).
