Help understanding status

Hey all,

 

Long time lurker, used to participate then took a break and now I'm back again after filing Chapter 7.  I have tried reaching out to my attorney and he's just not responding so I'm hoping someone here can help.  Sorry for the long post.

I originally had a different attorney and before my MOC I told him I wanted to reaffirm my car loan.  I never received paperwork for it and days before my objection to discharge was due, I decided to reach out (gut instinct) and that attorney was no longer at the firm.  I contacted the office staff who reached out to my new attorney, who told me I would need to contact the creditor to reaffirm the loan.  The creditor (Chase) told me I would need to file a motion to delay discharge because it would take approximately two weeks for them to process the reaffirmation paperwork.  I got on the new attorney a couple of times about getting the paperwork in on time because objection was due 7/15.  PACER shows the motion to delay was uploaded to documents on 7/17.  Today, I decided to check PACER and it lists an Order of Discharge for 7/22, status is awaiting closure.

Does this mean my bankruptcy has been discharged?  If so, what happens since we didn't get the reaffirmation paperwork in before the discharge?  If I pay off the car, will I get the title if the reaffirmation paperwork was not filed before the discharge happened?  Thanks in advance!

Did the trustee sign off yet after the MOC's where he/she says they release themselves any longer from the case? Seems like it's in limbo until the car affirmation is completed when you say awaiting closure. Also did you see any documents pertaining to the reaffirmation on PACER? Maybe take a drive to the lawyers office and see whats up.

Attorney finally got back to me.  He had to call the court and have the discharge vacated on the grounds that we had the motion to delay in on 7/17.  So it had been discharged today and then vacated.  There is no reaffirmation paperwork filed with the courts yet.  I called Chase again today and they said it takes a while to put together those documents but that the lady I talked to put a rush on it since we've already had to delay the discharge.  I just want it to be discharged but I also want to reaffirm that loan before discharge so I'm trying to be patient.  Thanks for your response!

Well thats great news. Least you know whats happening now and dont have to freak out any longer. Get dem papers in Chase and let this be over already I say! Well congrats. It just a matter of time the load will be lifted off your shoulders and a new life will begin. Congrats!
