Hi,
Need some guidance.
My Credit Score was up above 700. My home loan which was discharged and non-reaffirmed in a 2009 Chapter 7 bankruptcy was recently transferred to a new servicer (Nationstar / Mr. Cooper)
The BK public record fell of my report about 3 months ago.
When I filed Chapter 7 the loan was being serviced by Countrywide, then it went to Bank of America, then to Seterus, and now it is with Mr. Cooper. (who by the way assigned a new loan number)
We have paid and stayed in the home, but I've been running 1 payment behind for a long time and none of the servicers have reported the loan to the Credit Bureaus since the discharge until now.
Can Mr. Cooper report my payment history to a CB for a loan that was discharged in a BK 10 years ago?
Nationstar reported me as 30 days late for May 2019 which has tanked my score. I immediately filed disputes for me and my wife with all 3 CBs stating then loan was included in BK.
I also contacted Mr. Cooper and explained the situation to them, they said send paperwork in and they will investigate.
I really do not have the time and patience to deal with this after all we have been through and now that we are in a good place with our credit. I do plan on sending the BK paperwork to the servicer but in the meantime have also sought out legal counsel to perhaps have them handle it.
Any additional advice/steps I should be taking? I did establish a repayment plan w/ MR/ Cooper to get the loan current, but they said they will continue to report the loan as late until the repayment plan is completed.....
@RobWhIn3 - Good afternoon,
Make sure to send your BK paperwork to the servicer, certified mail. Give them 7-10 buisness days to respond.
