I need some help and any information anyone can give that may have some knowledge with this would be great. My husband and I got behind on our mortgage due to an automobile accident that we were involved in on January 24, 2009. My husband was the only one working because I have been on SSI Disability for about 3 years now. My husband was receiveing short term disability benefits of $411.00 a week and Melife Auto was paying him $250.00 a week but it was still 1/3 less than our normal income. We drained out savings within 3 months to keep up on all bills and got quickly behind with all the medical bills and normal everyday living expenses. My husband went from short term to long term disability on July 24, 2009 which cut our income again and instead of the $411 a week it dropped to $350 a week along with the $250.00 a week from Metlife. Along with the income being dropped down again our personal health insurance was dropped from his employer and in order to continue coverage we had to elect COBRA coverage at $1300.00 a month. We have tried to keep up paying as much as possible to our bills but felt like it was a losing battle. So in August facing foreclosure we decided that we would file Chapter 13 pro se because we did not have the income to pay for an attorney. Things in August began to improve and we knew that my husband would soon be returning back to work and we would be able to get caught up on bills and take care of the Chapter 13 issue. My husband was finally released by his doctor on September 3, 2009 to return to work on September 8, 2009. We notified his LTD company and notified Metlife of the status change and as of 9/8/09 our income stopped. But on September 8, 2009, while on his way back to his first day of work, he was involved in another automobile accident! At this point we have no income whatsoever because in order for his short term disability to kick back in he had to be back to work for at least 90 days. My husband will once again recieve a little income of $250.00 a week from the automobile insurance company but we have our first meeting of the creditors on October 2,2009 and we do not have the money for our monthly obligation for them. I have tried to speak with the Trustee's Office and all I am getting from them is that if we fail to not pay the first installment our case will be dismissed! Is there anything else we can do to avoid having our case dismissed?
