Can a bar legally ask you to give them your ID and ccard in order to start a tab? This is something I am unsure of

I would think a bar could ask you for your ID at any time to make sure they are in compliance with state liquor laws

In texas some areas are dry and make you join a private club in order to get around that,in that case they usually swipe your id here on the way in, however I do not think they are allowed to capture that info, I guess I am getting off topic though

True, but to start a tab some bars also ask for your id and keep them together. This just seems to be inviting easy fraud.

My theory on that is if your card has no money available than they still have your id to use to make sure you pay your tab

Re: PLEASE SEE I.D.

I'm not asking why a bar would do that, I definitely understand why, but I am curious if they are breaching the cardmember agreement in asking to hold onto your id

Re: PLEASE SEE I.D.

i've never had to leave my ID with a card, i guess different areas are different...  around here you normally show your ID at the door and then in the smaller places the waitress keeps a tab and you pay when you leave...  the larger places they swipe your card and hand it back to you and you settle up at the end of the night (I perfer this because i can leave when it gets busy and not have to stand in line for 15 minutes to get my card back)

Just curious if you just leave, is the tip automatically added?

Re: PLEASE SEE I.D.

Yeah they add 10% at most places, which is plenty fair to me

I don't see why this would be a violation of the cardmember agreement.  They're not conditioning a purchase on you showing ID.  They are conditioning you running a tab on giving ID.  If you don't want to let them hold your ID, pay after each drink.

Re: PLEASE SEE I.D.

Half of my cards are signed.

Most of the places I frequent have the PIN pads where you swipe the card yourself (places like CVS, Target, McDonald's, etc). Sometimes, my boss will send me to Staples to pick up supplies for the office with his AMEX. They have a PIN pad there too where you swipe, but the cashier does take the card since they have to put the CVV in (they've never bothered to match the signatures tho)

Places that consistently check are Best Buy (after swiping the card on their pad device), Radio Shack (same deal). It just doesn't happen as often as it probably should.

This past weekend, I did some shopping at Old Navy and while I did use their pad to Swipe, they did ask to see the card since I guess they also have to put the CVV in. The girl asked me for ID since it wasn't signed.
